Hey guys,
Does anybody know what the deal is with the National Pension Rebate? I'm a Canadian and I'll be leaving before my contract is finished. I'm not running, I'm going to go legal, and I'm just wanting to make sure that I can get back what I've already contributed. There isn't some funky clause that you've got to finish out your year is there? I'm kind of counting on this, 'cause I'm willing to bet my school is going to make me pay back my flight here even though I'll have been here for 8 months by the time I go. Any help would be appreciated. Thanks a lot.

You will not receive any help on this fact. You must complete your year, it's well known and unavoidable.

The only possibility in your case is that technically the employer cannot make you pay back flights or recruiters fees ... TECHNICALLY that is. They do it and they get away with it. If it's in your contract that you have to then you have no choice, but if it's not and they take it you can file complaints with the labor board and so on. It won't really work unless you have a good deal of issues and things that show you should get it. Even then, they can only tell your school to do it and if they don't you're out of luck. I can assure you this is the case, but some do get it back after it was taken.

This long winded approach to a response is that you're out of luck. You are the one breaking the contract .... suffer the consequences.

Lonely,
I've been looking long and hard for a while now and have not found anything that indicates that it is the completion of the contract that makes you eligible for the refund. Have you seen anything in writing anywhere saying that it is the completion of a contract that allows you to get your refund or is it just (like I've been seeing) the 'completion of employment' thing. If completion of employment is all that is required then should not a 'release from employment' form be sufficient? Still asking questions....Never finding the answers I seek.....

There is a form to fill out with your employer that allows you to get your pension back along with your last check. I am doing it next month.

Well are you Canadian or American ? I was assuming Canadian when I typed my response. Canadians qualify for payout on the pension at 12 months and Americans at 18 months.

Me again. I don't mean to be a pain in the neck, but from what I'm reading on that site I'm only seeing the 12 month/18 month clause in reference to collecting a pension upon reaching retirement age. I also know this to be true because my American friends recieve their pension rebate when they leave just the same as the rest of us. The site you pointed me to has been super helpful though, I'm just going to have to make sure by calling the NHIC. Will do that here in the next few days. From what I can see though, there seems to be no reason that a refund wouldn't be granted if I go to them with a 'Release of Employment'. Will let you know.
