I've just been told that I am required to work 2 days of the 3 Lunar New Year Holidays. The hogwan's reasoning is that "there are too many holidays in January, and we need to have 21 teaching days, so we will all have to work this holiday as a result".

I am definately planning on taking a stand because I have already booked a flight to Seoul (under the assumption that the 14 National Holidays my contract lists would be honored by my employer.)

I'm just wondering if anyone has any advice as to how I should approach this issue with my supervisor. I want to make it clear that I am not coming to work during those National Holidays, however, I'd like to be polite about it and remain in his good books. Any suggestions?

Stand firm. The owner is an arse, and it is so against the law it isn't funny. Tell him, (it is a guy right?) that you will call the labor board if you don't get the national holidays.

Thanks for the advice.

My director is male, but the one who actually runs the freakshow around here is a woman, who is part owner of the hogwan-- not a very nice person to deal with.

I told her today that I will not be working during the holiday as it is both against my contract, and against Korean Labor Laws. She replied with "well, we'll see what adjustments we can make to the schedule and we'll let you know if you can have your time off".

What a joke! These hogwan directors think they can push their employees around and expect us to take it. The problem at my hogwan is that all the Korean employees just take whatever crap the boss lady dishes out. (This is the most important holiday of the year and they are going to let their boss force them to work??!!) When I take a stand I end up labelled as 'a spoiled, trouble making foreigner' who actually has the nerve to demand what she is entitled to.

Regardless of the outcome the boss comes up with I will be on a plane to Seoul and will enjoy all 3 of the holidays I am legally entitiled to.

Check your contract.... Does it state that your off for national holidays? If it does.............talk to your director in a calm fashion and try and work it out. If he doesn't budge, call the labor office for help and find a decent job.

It doesn't matter what the contract says in this case. The minimum requirement under the labour standards act, as I understand it, is that you are entitled to recieve all national holidays off.

Viva says it's even included in her contract, that she's supposed to get this time off.

Call the labour board now. Don't let the director/owner get away with this "let's see if we can accomodate your holiday request" crap.

The call doesn't cost anything but will give the answers to at least clear up the situation and possibly intervene on your behalf by calling your employer to remind her what her duties are.

When in doubt as to what the law is, call the people who are supposed to know.

Cheers and good luck.

PS, I'll enjoy my time off next week...3 days holiday plus a weekend...Nice! Smile
