I don't think TV and radio are covered by the Bill Of Rights. Otherwise, it would be legal to show porn films on regular cable channels, and spew four-letter-words into the microphone on call-in shows. But of course those things aren't allowed.
Isn't there some legal thing about the airwaves being public property, and hence open to regulation in a way that books and movies aren't?
I don't doubt that the Democrats are pursuing a revived fairness doctrine purely for political gain, and that they would not be so fired up about balance in the media if Air America were the Number 1 station. That said, I don't think this can really be framed as a Bill Of Rights issue, unless you're also prepared to defend NBC showing hardcore porn at three in the afternoon. |

Free speech is absolute.
The government does not have the right to own the airwaves. The government should not be allowed to own most forms of property and never any property related to free speech activities.
Civil rights and civil liberties cannot be protected without absolute protection of all property rights.
And, yes, NBC should be free to show hardcore porn at three in the afternoon. It would be an unwise business decision. But, it is their absolute right under the First Amendment to the US Constitution. |

No, I can appreciate the anti-"Fairness" arguments being made. I just don't think it's legitimate to frame this as a First Amendment issue. |

Yeah, but as long as Limbaugh and Company accept the validity of airwave regulation(and really, how many social conservatives are fighting for porn on Saturday Morning TV?), then there are no serious First Amendment arguments being made by his side.
Anyone who feels strongly about airwave deregulation should start a movement toward that end. I can almost guarantee you that that is NOT what Limbaugh is pushing here. |

There is not much difference between Limbaugh and porn. Some people get off on one, some on the other, some are disgusted by either one or the other or both, and both are bad for young children.
Free Speech is absolute.
It's up to parents to protect their children. It is not a function of the government. |

| This really disappoints me. We've got everything we want--President, Senate, Congress. We're doing something right, we don't need to get Orwellian by imposing speech regulation on the radio. It's just petty. We would look like that one basketball team that beat the retarded kids 100-0. |

It's more than that Obama hasn't taken any steps, he's said he doesn't support the idea. This is the (at least) second thread Gopher has started about this topic. It's a non-starter. That doesn't stop Rush and his new recruit Gopher. Oh well.
One of the main criticisms of the Right is that they have nothing new to offer. This thread is an illustration of that. |
