Hi all,

So stupid me, I didn't file form 8802 requesting a Residence Certification before I came to South Korea. Once I got here, somebody told me all I needed was my passport. Now I'm hearing from my new co-teacher that this is false.

Is it too late to send in an 8802? I've been here about 6 months now. Also, the administrative assistant at my school never asked me for my 6166. She has also NOT been withholding part of my income for Korean taxes...!

Thanks for your help. Any information you can provide would be much appreciated!

Just do it now. It's easy and it will take a month for it to arrive. Were you the girl that sent me a cell-text about this last Friday?

1. You have to fill out the form 8802. It 3 pages and easy to complete. In the link below u will find the latest form and below there is also a pdf that instructs u in filling it out.

2. After u complete the form u have to pay 35$. You can do this online through the irs using your credit card. After they recieve ur payment they will generate a payment confirmation number. You have to write that in the apace provided in the 8802.

3. Now, you can simply fax the paperwork to the number in Philly that's in the instructions. I would give your school address for the irs to send as it's safer than ur home.

hmmm... can't seem to send private messages....

Can I have them send the 6166 to my home in the states (so that my parents can just mail it to me here)? Seems much easier

I guess you could but to me that sounds more complicated...why bother? There is a part i believe where they ask where you want it sent, just write your schools address (I always have anything important sent to my school just cause you never know if someone will take a piece of mail out of you mail box at ur apt cause it isn't usually locked) I mean why bother sending it twice? Be faster to have it sent direct as well.

I am a bit unclear as to whether or not we should state we are a resident or not. Also, did you have to provide previous tax information to them?

I got a confusing letter back, and I don't know how to respond to it. They have the dates wrong for one. They list "tax period Dec 31, 2007", but I am trying to apply for a period starting from like September 15, 2008.

It says I must add copies of all income statements, however, I am not finished working with the school. So, I don't know what my total income will be.

Then, there is a section where I have to declare the following:

"I was or will be a resident of the United States for the period that the treaty benefit is claimed and I am not required to file a U.S. Income Tax Return for the tax year ending _____ because (give reason)

______ "


I thought the whole point of tax exemption was that you didn't have to pay. I filled out originally that I am a resident. Then, I talked to my aunt who is a retired attorney. Her first reaction was that she thought I should be filing as a non-resident since I am not residing in the US now.

I'm applying for EPIK this Spetember...following advice here it looks like my wife and I would be well advised to arrive with forms 6166 in hand.

What period does this certification of residence need to be for? This year, last year, both? Anyone have any idea?

You'd be wise to bring it. Fill out the 8802, send it in, and wait. You'll get a letter about a month after stating the IRS is processing your form. A month after that, your 6166 will arrive. Everyone coming here for the first time should bring the 6166, just in case. The first two years working here are tax-free, but you may still have taxes withheld. And to get the refund, you'll need the 6166.

An easy rule: if you're a US citizen and you MUST file a tax return with the IRS, you're a resident of the US, no matter where you live. That works for most.

If you're a US citizen working overseas and make more than the minimum amount (8750 USD this year), you must file the return and report all income, including what you make overseas. Whether or not you pay taxes on overseas income depends on how long you're out of the USA.

I sent away for mine at the beginning of January, and I still have not gotten it back (though they cashed the check I sent a long time ago) so be warned that it could take a while.

Of course, my husband's co-teacher now says we have to have it by the 16th of March or else, which I am not convinced is true...

Thanks for the reply...when filling out the 8802 it asks which period you want certification of residency for.

Do we just need 2009? (which we can get by attaching a penalties of perjury statement ) and / or 2008 ?

Sorry for the unclear post. Yes, I mean for 2008, which is the year of the return you'll file this year. The miniumum applies for last year, though.
