Sorry if this is off topic, although looking at posts in the 'off topic' 'travel' and 'Job-related' forums leads me to believe that this wouldn't really fit very well there either.

As I have said on the forums in other places before I was recently accepted to study at an MBA program in the U.S. I currently work for a Korean company as an accountant. I am a U.S. citizen and my wife is a Korean citizen. We have been here living in Korea for 3.5 years. Until now we haven't really worried about getting immigration proceedings done for my wife. However, we will be going to the states for school and we have started the process for getting her a visa (she already has a tourist visa).

I am currently filling out the I-864 and was wondering if someone who has gone through the process would be able to answer a few questions. I currently make more than the required 125% above the poverty line to support my family and have done so for the past three years. I've filled and kept copies of all U.S. federal taxes for the past 5 years. One concern is regarding the country of domicile. Currently we 'reside' in Korea, as do most English teachers or business men. In order to put the U.S. as my country of domicile, I have to prove that in good faith we intend to move to the U.S. I can do this with proof of acceptance to graduate school in the U.S so I don't figure this will be much of a problem.

My question is with me using school as the main evidence to support domicile in the U.S. Can I still be the sole sponsor for my wife? Going to school in the U.S. would indicate that my job here in Korea would end and that I won't have future cash inflow. (The purpose of the I-864 is to prove that you can support the family member financial.)

The way I see it, I can fulfill both requirements of income and domicile but they conflict with each other. I could have my parents fill out a supporting document but I would rather not.

Any advice would be appreciated.

Anyone that has delt with immigration knows that you need to be prepared for anything.
