Midnight Run Questions

I am thinking about doing a midnight run this weekend maybe Sat or Sun night. I still have a release letter from my old boss(job #2). I have started my new job but I don't have a new visa. They are currently processing my paperwork at immigration for my new job (job#3).(they have the file number - SUB 00 etc to go to Fukuoka Japan). What I want to know is can I leave the country without any problems? I am ready to leave indefinitely.

Is there an expiration date on a release letter (Dated 1/16/2009)

This is my 3rd job here in a year. the second job (Mokdong W Academy) still owes me money for 2 paychecks (that's why I left). I filed a case against them at the Labor Board but haven't gotten my money.

So if I try and leave (I guess midnight so no phone calls are made) will there be any complications? I am ready to get the *beep* outta here.

No problem at all unless you are in violation of your stay (immigration violation).

Just head for the airport or ferry and away you go.

My guess is they will fine your butt at the airport. Youhave 1-7 days after a release letter is given to get out of the country. Or if you are lucky in that same time pay 100,000 won for a 30 day extension.

In yoru case its been over 2 months. They could fine you for all those days. And the fact your illigal, you may be better off waiting until you get your ARC card then leave. Vould be 2-3M won in fees.

According to the Law Guide from the Suwon Migrant Workers Center -

*Voluntary Departure
- As of 2007, in case of voluntary departure, the exemption of illegal-staying fine and entry regulation (or easing)
- Report voluntary departure at Airport Immigration Office on the day of departure.

Fantastic English aside, it appears that as long as you tell them you're leaving, and are very apologetic etc, then you won't have to pay a fine, or pay a substantially reduced fine. Don't worry about it. If you are at the gate, ticket in hand to leave, and you don't have money for a fine, I doubt that they would drag you back to the city, and throw you in jail. So, apologize, be broke, and go home.

Which one of you is correct. ttompatz says it's okay to leave but kasain says I will get fined. If I go indirectly to America, Go to a foreign country (china, Japan, whatever ) first then go to America will that disguise the fact that I could be getting a Visa in a foreign country?

To have a successful midnight run, you must start running at exactly midnight. Not a minute later. It also help to do it while the moon is rising.

I do feel sorry for you and your situation, but i have to admit, i did laugh when i read that comment

Yes this is true. The longer you stay the faster you will have to run. If you are in bad shape, Immigration will catch you. But if you are in good shape and you run really fast, you might get away.

On a side note, a friend of mine came over from China on the ferry. He is half Japanese, but 100% American - knows no language but English. When he entered the country at Incheon, at the seaport, they had no one there who spoke English. This was good because you must have proof of a sponsor or a ticket in hand to leave the country when you enter. He had none of these things, and because he didn't know any Korean (and they knew no English) they just waved him in to avoid the frustration.

Long story short, try leaving out of a place where white folks don't go - i.e. cheap ferry to China/Japan. Even if you are in violation, it is a lot more likely you'll run into someone who doesn't want to argue in those places, as opposed to at the airport.
