First: I read the private tutoring sticky thread, and it's a jumbled mess and most talk is verifying which F class visas allow tutoring and not much on E class.
Second: I want to post a new thread to get clear answers, if a mod feels like moving this into the sticky somehow, then feel free, but I feel it will get proper attention in a new thread. The sticky has become jumbled and abandoned.
From everything I read it appears private tutoring on an E-2 is illegal. I have also read a lot that says it is possible. So which is it? Is it possible to get a tutor license on an e-2 with and/or without the help of your employer? (Say I work 5-6 hours a day and I got a heck of a lot of free time). I think the employer wouldn't mind.
I have 2 objectives. One is to make more money if it's possible. The second is to help my girlfriend (Korean native) to get a part time job. So this is an alternative -->
If it's not legal for me to teach, what about a duo of sorts. My girlfriend is native Korean and she is looking for a part time job, so if it's her primary source of income and I say-- help out, does this avoid the legal issue? If I am not pocketing any money and just helping her, then I am not making money and thus not breaking any law? From what I have read it's only illegal to make profit from an outside source.
Another possibility would be the proper F class visa. Is it possible to upgrade an E-2? What are the requirements for an F class? (I know I can google that and I will, but if anyone wants to post info it may help me and other users in the long run). |

you can't just "upgrade" to a F visa. you either get married or have Korean ancestry. They won't hand out the residency visa (F-5) so easily unless you had a F-2 visa first
second, if your gf wants to tutor that is fine. More power to her. You may not legally teach on the side and earn money for it. |

Here it is for you in simple terms - Teaching anywhere but what is on you visa aka usually one school is ILLEGAL. People on E-2 can not tutor.
Careful even with helping. As some people comment some people will not believe you are not getting paid. Also I have heard that volunteering like at a orphanage has got some people into trouble. To some immi official even volunteer work is still work even if you do not get paid or not.
True the odds of you getting caught and deport are slim but all it takes is one over zealous person to dob you in. And the most likely person will be your girlfriend the second you dump her.
Also, have you tried asking your school/boss for more work? Some schools will let your work a second job if you ask and some might even let you keep all of the money. |

that is so true... about 90% of the stories i have heard of people getting caught are by x-GFs telling immigration after a break up. |

If you have some serious cash they will. Any foreigner who has a business which has 20 korean employees can get an F5 now.
There was an announcement about that 1-2 months ago.

Someone quoted an immi official a few weeks ago that explicitly stated if money wasn't changing hands it wasn't illegal. |

That I take with a small grain of salt. Remember this is immi. Ask one office what you need to do to renew and the will give your one answer. Ask the next day and you will get another answer. Go to a different office in another city and you will get a completely new answer.
I have heard of people been caught for illegal tutoring, being fined and left alone. I have then heard others being picked up and given notice to leave the country. Each instance is up to the officer.
In the end even if teaching for fun/volunteer was not illegal it is best not to
do it unless you are willing to play the immigration game. Hope you roll a seven. |
