Unless you've been working for 6 months (3 months in some provinces), Labor Board is useless.
So, what to do????
Was let go by school due to financial problems. Was told I would get full salary according to contract. Owner has now disappeared and sold the school while his wife is still running another hagwon.
Any ideas as to how I could get anything? |

Your only option is to get a lawyer and sue but I personally think that's a waste of time. Korea isn't known for its worldclass judicial system.

Maybe you could go to the other hakwon and ask for money there?
Most likely though you're S.O.L.
But on the bright side, you're in Korea, so you can get your papers and get a new job... and interview for the job before hand.
Or... you can switch to a public school job. Pretty much you're screwed on the cash though. |

How do people get their papers together so quickly upon realizing they're about to be unemployed? My job is about to tank right now, and I don't have a criminal background check nor my transcripts with me right now. Getting both are going to take time, probably more than I have left here in Korea at the moment as I suspect I'm going to find out any day now that the boss went bankrupt and will close the school. Finding out actual information about the job has been an adventure because the boss just disappeared and all I ever seem to hear is hearsay. Meanwhile, the Korean teachers (over the last week or so) have just quit one after another because they have the option of just taking other jobs. |

Yes, WHO is saying this?
I worked at my first hagwon for 4 months and was able to file with Labor, have a hearing, and win a ruling. I know people who've filed with Labor after working for less than 2 months. |

I visited the Labor Office and explained the situation. For the province I was in they require 6 months work. If I had worked for 6+ months then the government would have paid the bill....and i assume try to collect from the school.
He called my director who explained the owner ran way. Was told my only hope is to wait and see if he returns or deal with the Korean legal system....
Difficult to deal with his wife as I'm working in a different city now and she doesn't speak English. Will have a Korean call her sporadically in hopes that she gives me something....but guess it's all up to her. |

What(How much) do they owe you? The person you spoke with at the labor ministry could speak English? It sounds like whoever you dealt with there told you a story, have you called the labor ministry english phone line? Only telling us what the labor ministry said doesn't help much, what did you tell the person at the labor ministry? If we know that then we might be able to tell you whether the labor ministry is... |

Yea, just magically wait there while your visa status becomes nothing. He'll show up, knocking on your door (to an apartment you won't get kicked out of :::crossing fingers::: ) with all your money. On top of that, he will apologize for everything, especially causing you such an inconvenience. You will get a new contract offer with twice as much, and instead of that 1 room studio apartment you have now, the new one will have a guest room so you can invite people over.

Labour fobbed you off. Don't worry you can still get all your shit together and go back. Be insistent, file the complaint and keep at them until you get a hearing date. Which your director want turn up to either. So you'll probably have to go three times before they decide in your favour.
You main priority should be to find a new job, secure your stay here to see this through. |

If Labor refuses to help you, there's nothing stopping you from suing the school directly. You don't need Labor's help or approval to file a lawsuit. It all depends how much your time and effort is worth to get it done (the money involved in filing the lawsuit is minimal, so that's not the real concern). |

Explained everything at Labour Office through 1350 (ext 7)....official didn't speak English.
He said government would pay the salary that was owed to me if I had worked 6+ months. Same kind of deal I guess where government will cover employees where business goes bankrupt....with a lot of legal nonsense i suppose.
His recommendation after pushing him was to call the Korean Legal Aid Corporation.
Problem with suing school directly is the owner sold it....and disappeared. My understanding is that he sold the other school he owned as well. So don't think the new owner is responsible for my bill. Contract states i require 40 days notice....owed 30 days.
I'm already working at a new job in a new city. Had to do a visa run as couldn't transfer E2 due to no arc....was let go couple weeks after beginning.
Don't know....sue a guy that's hanging out in an unknown country? |

It's good that you are now working legally. Only you know whether it's worth pursuing since you've yet to say how much you are owed. Of course, you're the only one that matters when deciding and it's okay that you don't seem to want any input on that matter. |
