| So two weeks ago, my hogwan agreed to let me out of my visa, told me I was free to pursue other work options. The same day, I got a new job. Today, I heard that my hogwan boss is trying to recoup fees from my new job owner and holding my visa hostage to do so. (This was after the shady sob said he wanted everything to go smoothly for the both of us.) Anyway, my payday is the 25th, at this point, I am worried that my hogwan is either not going to pay me, or take a substantial amount of money out of my check. I have worked at this hogwan for 6 months and there is nothing in the contract that says anything about repayment of airline fees. (Not that they care about the contract anyway) So, what do you think I should do? I am considering not going in for work tomorrow, the contract has been violated on their end about 700 times...how will I get out of my Visa!? |

if payday isn't until the 25th - seems you need to wait until then to see - not going in to work certainly isn't going to be in your favor - if anything you need to be as cool as possible until payday.
is that your last day? |

they never gave me an official last day.
At this point it has boiled over for me....How can I get out of my visa? |

Whether he cares about the contract is irrelevant. What matters is that the Labor Board and the courts do care about the contract except where the contract violates law.

That's a very bad plan in this country. The Labor Board is known for viewing that action as a more egregious violation of the contract than anything at all the employer has done. |

Did you get a letter of release form your old employer? If not, then he can do whatever he likes - including making the demands he's making nowof your new employer. Also, you could be out of luck for a new job job until your old visa expires. The only alternative, and it is not fail safe, is it to leave the country, turn in your arc card, and begin he whole process again to get a new visa.
As for your old boss demanding recompense from your new employer, that's between them, just don't worry about it. If he deducts from your salary to cover it, then its between him, you and the labor board.
If youre still working at your old job, continue going to work everyday until it's resolved or give official written notice with an end date and leave when that day arrives.
BTW I hope your new job is a public school so you dont have to deal with as much BS next time. PS transfers from hagwons are relatively easy and immi sometimes accommodates them with special care. |

They arent going to give me an LOR, I have asked for it about 7 times in the last 3 months with no luck whatsoever. I just got an email from my directors husband (he is american) basically saying I am screwed. I dont think i am going into work today. |

What I am saying to you though is A. they are going to take my money for the plane ticket and whatever other fees they want out of my check. They agreed to transfer the VISA to another Hog, when they did that, they sandbagged him, asking for X amount of money and all sorts of stuff. Honestly, I am left with no other option. |

What I am saying is that you should pack your bags. Call up the new hagwon. Tell them of your intentions. Have them agree to pay for your visa run to Japan. Go to immigration. Demand an exit order. Move into your new digs. Head to Japan and return to work for the new hagwon.
Otherwise, pick up your phone and call the labor board. |

Are you staying in Ulsan? Why not talk to your new school about having them help pay these expenses. It is common for the new school to pay the old school some cash. Your new school has just saved a sizable sum by hiring you in country, so they surely can help you in this situation.
PS, could you pm the name of the school? Ulsan has its fair share of douches |

I think the guy who started this thread is dumb. You are making your situation worse. Go towork until the 25th. Regardless if he pays you or not, by you not showing up he can fine you, get you deported, and you cant do a Japan visa run anymore.
Work until the 24th thats a Friday, the 25th is a Saturday. I am sure regardless if yoru airfare is in yoru contract he can go after it as it is Korea. You sound like a doushbag just as much as him. Him flying you over here and you thinking you dont owe him crap. Then you think you can move on? You are not in Japanw here you owe your visa.
Play by the rules and don't act like a dummy. I went through shit at a hogwan as well, but I managed to work through it to get to a public school. Pick yourself up by yoru balls and honnor the CONTRACT YOU SIGNED!!!
P.S. No public school will hire you if you dishonnored a hogwan contract. The see you as a dushbag. |

That's actually good advice. It shows the employee is willing to abide by the rules and the laws.

If it's not in the contract, the employer owes the employee exactly nothing for the flight over.
