I'd like to hear stories from anyone who successfully broke their contract before the year's end and got a second E-2 visa without a letter of release.

I've heard too many conflicting stories and my current employer is threatening to report me to immigration and have me blacklisted unless I work for the full two-year contract. They've also threatened to tell immigration that I've done a bunch of stuff that I haven't, so I want to know how screwed I'll be if they go through with their threats.

I'd like to hear how many threads were started on the exact same topic in this short amount of time. There are threads here going back to 2003. Anyone care to do the research?

I am basically in the same boat as this guy. Calling Immi right now to see what my options are.

How can you have a two-year contract on an E-2 visa? Care to elaborate?

I ask because to the best of my knowledge the E-2 is only good for ONE year at a time. To go for a second year, you need to go down to Immigration just before the end of the first contract and renew it.

If you signed a contract that had two years as the duration and you are on a E-2...could you give us more information?

Yes, I have a one-year visa and a two-year contract.

John, let me know what immigration said. They told me that if my university blacklists me, it will be "very difficult" to get another E2. However, the woman I talked to didn't seem to be all that knowledgable, and suggested I go to immigration in person.

I thought there wasn't a blacklist for immigration. They can put a mark on your file, but that's only if you break the law etc....

I left in March 2008 and came back in June with a new E-2 visa - I went back to England to get it. Cool

Could you elaborate, please? Did your employer fight you and/or threaten to blacklist you at immigration?

Yes, I have a one-year visa and a two-year contract.

John, let me know what immigration said. They told me that if my university blacklists me, it will be "very difficult" to get another E2. However, the woman I talked to didn't seem to be all that knowledgable, and suggested I go to immigration in person.


This is probably your best bet. At least you get your side of the story heard first if it comes to that. Also I'd ask about that length of the contract.

And as for your university I'd just tell them I'd contact the labor board.

I wouldn't worry too much about it...a lot of employers like to pretend that they have pull at Immigration.

I had something like this happen to a friend of mine, except that this was a hakwon and not a university. They were threatening him saying "You'll never work in Korea again", "We have friends at Immigration" and the like B.S.

After glancing at his contract I realized that they weren't paying pension, health insurance or even the proper amount of tax. I advised him to call their bluff and threaten to call these offices if they didn't give him a letter of release. He got his LOR and had no trouble getting another job mid-contract.

I don't know how much that helps...but anyway I hope things work out for you.

If worst comes to worst I suppose you could always do such a crappy job that they fire you...

No - it was a hagwon and as soon as the daft cow started shouting at me I just walked so there was no time for her to shout out daft threats! Laughing

I wrote an email to worknplay to ask if I had to wait to get a new E2 and they said no - I could apply straightaway - the reason it took till June is because I had to get a new 10 year passport and that takes ages in the UK! Evil or Very Mad

Here's my deal. Worked at a hoggie. It sucked. Got sick. Not really. Had Korean K-gal take me to see her doctor friend she has known since middle school. Explained I was teaching 53 classes (yeah, 53) a week and it was causing health problems. Got letter from doc told boss less work. Boss said no. Doc said he has to go. Got letter of release and transferred my visa to new school. Did not leave country. No new c.r.c , no visa run, no sh#t. Here's the requirements: a korean FRIEND, one who cares for you. B/F G/F are best. There is a hierarchy here. And doctor trumps hagwon boss. Truth. Went from hagwon to public elementary no problem. Get to new school, head teacher she b#tch from hell. Wait one week to see if she was like this everyday. She was. Spoke to her in firm but not rude tone of voice. Said " Boss, if you are going to treat me this way everyday, you need to get a new teacher and I will transfer to a new school". Now, nice everyday. Nip it in the bud or be miserable for a year. Your choice. Who needs who? Exactly. P.M. if you need more details. Good luck.
