I realise there is a contract thread but it sometimes doesn't get noticed sometimes. In a bit of a hurry so would appreciate if anyone could take a look at this part time job I might be doing (YES, I have an F2 visa)
the holes I see, are the no mentioning of tax rate, hours, days of work which I will get fixed. also the half pay for quitting within 6 months. Anything else? thanks

This EMPLOYMENT AGREEMENT has been made this day , 2009 between the above mentioned �Employer�, ________________, and the above mentioned �Teacher�,
, under the terms and conditions set forth below.
Both parties agree on the following terms and conditions:
CLAUSE 1 (APPOINTMENT)
a. The employer agrees to employ the teacher during the period stipulated herein.
b. The teacher agrees to accept employment and will work in his/her full capacity for the school.
CLAUSE 2 (THE EMPLOYER�S RESPONSIBILITIES)
a. The employer is required to provide support to the teacher in his/her full capacity, working together to provide quality English instruction under the terms stated in this contract.
b. The employer will honor the terms and conditions of employment, as stated within this contract.
c. The employer will guarantee the teacher a salary of 50,000 Korean Won per one teaching class in consideration of the teacher�s teaching hours and proper preparation for the classes.
d. The employer will ensure the employee receives an adequate induction programme before commencing teaching.
CLAUSE 3 (THE TEACHER�S RESPONSIBILITIES AND DUTIES)
a. During the terms of this Agreement, the teacher must cooperate and comply with the instructions and disciplines of the school.
b. The teacher MUST be adequately prepared for the classes in advance, preparing a detailed lesson plan for every class.
c. At all times during the term of this contract, teachers must maintain a clean and neat appearance. While suits and ties are not mandatory, a professional appearance is desirable. (no holes in clothing, visible piercing(s), etc.)
d. The teacher�s work will include the following:
Teaching the English to students
Indoor/outdoor classroom activities for/with students
Level testing, grading, evaluation, and assessment of students
Providing students with individualized care
Attending teacher�s meetings
CLAUSE 4 (PAYMENT CONDITION)
a. The payment of the teachers� salary is to be made on the end of each month, after the required work is completed.
b. The payment is 50,000 Korean Won per one teaching class.
Attendance at scheduled staff meetings, along with preparation for classes is mandatory and not considered as teaching time.
c. If the teacher quits teaching class within contract duration, the payment of the last month is 25,000 Korean Won per one teaching class.
CLAUSE 5 (DISMISSAL OR VOLUNTARY RESIGNATION)
a. The employer reserves the right to dismiss the teacher from employment for the following causes:
1. Neglect or inability to perform his/her duties stipulated in this agreement
2. Frequent absences from work
3. Receiving two warning letters
4. Criminal behavior or misconduct according to Korean Law.
b. The employer agrees to give the employee the courtesy of 7 days notice in the event of dismissal. However, in the case of a teacher�s criminal behavior, misconduct, or with any discretion thereof, he/she will be dismissed from employment immediately, without warning or notice. Overall, the employer reserves to right to dismiss an employee at anytime.
c. In the event the teacher resigns from employment, he/she can do so giving 30 days notice to the employer.
CLAUSE 6 (GOVERNING LAW & JURISDICTION)
a. This Agreement is governed under the laws of the Republic of Korea and any breach of this contract, of any form, may result in prosecution through the legal system in the Republic of Korea.
b. This Agreement is made final and firm unless any material modification or amendment to this Agreement is executed with the full knowledge and consent of the undersigned and incorporated into this Agreement.
In witness thereof, we have affixed our signatures hereon. |

I never visit the contract sticky. Never think of it. But the mod will lock this thread soon enough.
A contract with no hours is kinda foolish. |

| Is this a part time job on top of a regular full time gig? If so, I believe you'll need the original E2 sponsor's permission to add it to your ARC. (is that correct, teachers?) |

With an f2, f4, or f5 visa, that is not true. |

Contracts do not mean much in this kinda school. It sounds like a CDI, or a copycat. You'll have to feel out the school, the co-workers, and the meetings to see if it is for you.
Sounds good though, I guess. 50K/hr! wow. Some E-2's don't think that's possible in Korea, lol. At least the dumber ones. They're the reasons wages are so low. I told an E-2 about a 50K/hr job and they couldn't believe it, like I was making this crap up. Kept asking and asking and asking....anyway. She's happy at 12,500. Couldn't believe an F could get 50K/hr for 5 hours in a row in one day while her crappy hagwon pays 12K/hr for E-2s and 25/K for FT Fs!!!! Couldn't understand that an F can get 50/hr even in a 5 hour block and that is cheap! Then, when the F visa said, ok, 30K is ok and he'll find an illegal for the 10K to work the rest of the time, she still couldn't believe the gall of the F visa! The nerve! The guy wants market price. Never mind that an F can easily secure a one on one for 40-50. So, why go to some crap hagwon in BF for 30K and teach 12 kids? When he/she gets more doing a one on one?
Needless to say, the F in question is about pissed off and about to forget about the PT crapwon as well as the trouble of setting up an illegal to help the school. He's a crap arse for even trying. What a piece of crap. He should just do 40 hours at the crapwon for 10K/hour.
Someone should call immigration on his sorry arse. Probably married to a korean who can't even speak fluent english, the basatrrd. So much for helping people out. It's not worth it in the end, is it? |
