I have received word through the grapevine that Chungdahm April intends to add Saturday classes to its schedule, thus operating 6 days a week.

This is not an unsubstantiated rumour as a friend of mine was told so directly by management however I have not been officially notified by my own VP/Director either. This is apparently a nationwide policy and is not restricted to just one branch.

Needless to say there are going to be hundreds of pissed off April instructors as CDI expressly advertises a Monday to Friday schedule in their recruiting literature (for April).

Has anyone else heard anything about this?

Im going to wait for the official word from my director but I'm not hopeful. There are plenty of M-F jobs here in Korea and that's what I signed up for so that's what Im going to continue doing, with this company or without it.

Matt, check your Teaching Service Agreement. Under 1) Work Period and Compensation, does Article 1.2 have this sentence:

teaching hours per month from Monday through Saturday.

My contract (and those of two other friends in separate schools) says "a total of 120 teaching hours per month and FIVE teaching days per week"

So you get two days off a week. Doesn't have to be Saturday and Sunday.

I just got asked about this myself. I am sort of being forced into it, by the sounds of things. They are asking everyone to sign a piece of paper, I have not seen yet and am not certain I will agree to sign. I feel I am being bullied into it as my director told me he would have to replace me if i could not switch. I am six months into my second contract with them. Because of the structure of the program it would involve working Monday to Saturday...only Sunday off. With a pay raise. I don't think any of the individual schools are very happy about this, but the decision is being considered by someone higher up.

Now scoot down to clause 2) Termination, does it look like this?

2.1 The Agreement may be terminated by providing minimum forty-five (45) days advance notice in writing. In order to protect the continuity of education for the Company�s students, both parties will faithfully fulfill all of their duties under this Agreement until its actual termination. In the event this Agreement is terminated prior to the End Date; 1) any and all portions of the reimbursed airplane ticket fee will be withheld from Instructor�s salary; and 2) additional One Million Korean (1,000,000) Won will be withheld from Instructor�s salary to subsidize the recruiting cost for a replacement instructor on the part of Company.

2.2 The Company may terminate this Agreement without prior notice to the Instructor under Article 2.1 for any of the following reasons: (i) violations of the laws of the Republic of Korea; ii) being under the influence of alcohol or drugs while teaching class or attending scheduled meetings; (iii) tardiness to class on a continuous basis�two (2) or more times per three (3) month period; iv) endangerment or contributing to the delinquency of a student (v) failure to keep regularly scheduled class hours on a continuous basis; (vi) absence from classes without prior approval from the Company; and vii) breach of any covenants contained in Article 3 below.

2.3 In the event that the Instructor refuses the teaching schedule as provided in Article 1.2 prior to the Commencement Date or anytime thereafter up to the end of the term of the Agreement, the Company may terminate this Agreement without prior notice under Article 2.1.

This was taken from a CDI contract offered last summer. Are they still trying to soak you a million won AND the airfare reiumbursement if you quit?

45 days notice should get you saved up enough to pay them off. Evil or Very Mad

Stevil, did they send you on a visa run to Japan? Or back to your home country and back again when your first contract ran out?

Nope...I did everything here in the country. I did go outside of the country though during the year. Bu I didn't do anything related to my visa there.

My contract looks slightly different then that. I think I only have to pay the 1 million won if I quit.

I should note that they payed for a return ticket just prior to my visa running out. So I did get the airfare that was in my first contract.

This may be in the contract but is it legal? It may well be but a call to the Labour Board (1350 from a landline), or refering to the thread "how to legally hammer your hagwon" may help.

If they told people no Saturdays in their ad but then require you to work them (regardless of what is in the contract) smacks of unconscionable conduct, I just don't know if that cancels a contract here.

Ok just to follow up, my school is NOT going ahead with this plan but I can confirm that it is a new corporate policy.

The individual directors can operate on Saturday at their own discretion but thankfully my boss doesn't think it will be profitable. I was also told that the parents are against it so that certainly works in our favour.

Technically you are correct but every CDI April branch in the country follows a M-F schedule. The Saturday plan was for teachers to work 6 days a week, and has nothing to do with giving additional time off M-F.

It does not say quit. It says termination of the contract, which technically includes getting fired. I wouldn't sign such a one-sided BS contract if they offered 10 million a month.

No, it is not. That particular clause is void because it contravenes labor laws on the prohibition of penalty clauses. It is a penalty clause. It is not enforceable. Labor Board will tell them to get bent if they try to take the money.

Glad to hear that it is up to the discretion of the hagwon owner. I am pretty sure my director will not go through with it, as he mentioned that the mothers they had asked were also not interested. Perhaps they got me all bothered for nothing.
