Does anyone have any experience filing civil damages against their hagwon after they were terminated?

I received a termination notice for reasons that even the labor office I contacted said were "crazy" and will be easy to appeal later on (labor official mentioned something about slander laws and the possibility of visiting a local police station to file a complaint.

(note: the hagwon threatened me with "civil damages" when it learned I filed a labor petition, then backed off and offered me money to skip my petition hearing).

(1) This past week the institute first phoned my students and told them that I quit for personal reasons.

(2) Then another student told me an intitute employee explained to her that I was fired because there was a problem between me and management and that I failed to follow director's orders to do extra work, level tests (student assessments).

This last comment was incredible, because I took the institute to Labor over the extra work, which the institute insisted I perform outside my contract hours for no pay. They lost. They actually offered me money before my appointment and suggested I skip it. So to tell students that's the resaon why I was fired is over the top.

Shocked So... exactly what are you thinking of suing for?

If it�s the money the LRC has determined you are owed, you must give time to pay before initiating a suit.

If its slander, you'd better have more than the hearsay 'evidence' of a student. What would the damages be... what will happen when you subpoena the student?

ATEK can provide guidance and information. That's their stated mandate and the extent of their ability. The OP will most likely get the same advice here as he would from them: walk away from the scum boss and chalk it up to a terrible learning experience.

The conversation took place in front of me and another student. The student later translated for me what she and the institute employee were talking about in hangeul. She's a doctor with her own clinic. The other student is an engineer. They both have documented it in writing.

The point: to get the institute to think twice about harming teachers.

A student who has been coming to the institute on and off asked me this past week if we have one year contracts because teachers don't last very long there.

Then 'go for it' and let the judge decide damages. Cool

P.S. Hangeul is the Korean alphabet - not the language.

You are better off consulting a lawyer than Dave's.

You can find a lawyer in the usual ways. If all else fails, you might get a list from your embassy.

From my previous experience, a Korean lawyer will not consult for free. You pay him or her and then they will let you know if you can keep on paying them.

I recall the original poster stating that he started work in February 09.

We are now in May 09.

In other words, he has lasted a grand total of 3 months on the job and racked up about somewhere around 60-70 hours of actual teaching time.

So the question ... is it worth launching legal action for such a piddling amount?

It is madness, go home.
