My contract ends this week. I have another job lined up that will start a week later. My previous school will cancel my visa this week and will receive an exit order.
My question is, can you apply for a new E-2 visa during the grace period before your exit order is up? Or, do I have to leave to Japan, come back as a tourist and THEN apply for my new E-2 and then do another visa run? It seems silly to have to leave the country twice.

Everything depends on what you mean by the term "ends":
Does your contract expire?
Did you resign?
Were you fired? |

I put in my 30 day notice a month ago. I am leaving on good terms with the school. I'm under the impression that my visa will be canceled following the last day of work but wasn't sure if I needed to leave for Japan and come back on a tourist visa until I apply for my next E-2. |

Is a Letter or Release needed if your visa expires at year's end, and you want to start a new job, outside the public schools?
I've had it up to the ears with my public school- and the help getting another PS was minimal at best- so I found a better gig outside the PS, at least money wise. But is the release letter necessary? Logic dictates of course not, as the year is up, but knowing how dislogic is the norm rather than the exception, I thought it prudent to ask!  |

OP,
You could leave, come back on a tourist visa and then do a visa run. However, because you are leaving on good terms and have a LoR, you could have sponsorship of your visa transferred to your new employer IF your new employer will date the new contract to start immediately (the day after) your current contract ends. I believe the new employer would have to go to Immi with you to apply for this transfer. If you do this, remember - your current period of sojourn will still apply.

Yes I am leaving on good terms, but, per the Dept. of Edu. in my province they don't provide release letters (got a long-winded explanation that made no sense that I didn't pursue further). I will not be transferring my visa but rather applying for a new one.
I will have X amount of days left to leave the country after my visa is canceled. Can I apply for my new E-2 during this 'exit order time' or do I need to come back and apply as a tourist?
I have all my documents (transcripts/degree) but was told I didn't need a new CBC if I haven't left yet. I'm afraid if I leave and come back as a tourist I'll need a new CBC since I've left the country (even though it's for a few hours). |

If I leave, come back as a tourist and apply for a new E-2, will I need a new CBC even though my original one is on file with immi and was issues less than 6 months ago? |

Well... you can't be issued a new, E-2 while under an exit order because you can't hold two visas at once. Likewise, you can't be issued an E-2 while on a tourist visa. |

A letter of release is required. If you can't get this your VISA cannot be transferred, which means you have to apply for a new VISA. This means you will likely have to leave the country. |
