ok.. so
under the contract im suppose to get my airfare ticket back home
but im not leaving and im gonna get another job
so i asked by director if i can get money instead of the airplane fare and she said "no"
which i think seems total fucking bullshit to me
does anyone know what is suppose to be done legally under this situation?
also, there she might have a leverage with this argument because im working illegally (dont have a degree)

Shit creek and paddle spring to mind!
You would have had no legal re-course even if you did have a degree.
Most contracts say flight to and from your home country.
I know of instances where people have tried to go to Thailand instead of the US and the school has refused, even though it would have saved the school a lot of money! |

Your post is kind of funny. I can't say I know any teacher who has worked for a hogwon and resigned or left for another school who got money in place of there airfare ticket.
Even people who stay at same school don't get bonuses, hence why 99% of people go home for a month and let the new employer pay to bring you back.
If you are switching schools some hogwons will give you a relocation allowance say 300,000 but thats up to the indivdual hogwon.
You may also want to be worried about your severence pay. Let see if you get that.
Technicaly yoru employer is in the right if he is following your contract to the letter. It says he pay for you to go home, but you are staying what means he has no obligation to send you home. No plane ticket is needed.
At one hogwon I was at a teacher resigning asked for teh one week vacation that the school buy a roundtrip ticket home. The school did. Other teachers who stay at schools ask for more free time or money. |

Don't think you stand a chance.
Where I work, if people do not take the airfare home, we give them 700,000 won.
Some people have said that they have booked their ticket home, then cancelled the ticket and got the refund. Most schools will book the ticket for you though, so that they can ensure getting the cheapest flight, and therefore if you cancel the ticket you would not get the full money back or even possibly, the money would go back to the person who bought the ticket. |

My old hogwan gave me 1.3 million won in place of a return ticket when I re-signed with them for one year.
I think it's fair to ask for money in lieu of an air ticket. Not everyone wants to go home. |

You stayed with them, and that is why you were given the money. If you had been moving to another school I am fairly sure you would have been given the same option the OP is faced with. Not pleasant to be in that situation, but I have been there and the best I got out of my old hagwon was a worthless return ticket that expired shortly after I left the place. That was of course back in the day when recruiters were buying round trip tickets for those coming to Korea. Now the limits are much greater than they were for those of us coming over 5 years ago. |

The airfare clause is actually there because of immigration and not because of the teachers. Immigration wants all teachers to have the means to leave once their contract is over. Since the school is sponsoring your Visa they need to make sure that you can leave once your contract is finished. If you want to stay and sign on with a new school they are not responsible to give you anything.
Same thing goes for the new school they aren't obligated to fly you in since you're already here. If you feel that you're being cheated then take the flight home and get the new school to fly you back. You get what you signed up for and it's always nice to go back and recharge before doing another year. |

So it is reported that there are over 1 million Foreigners living in Korea. Last I read, most of those were NOT Esl teachers. So, does that mean that all the migrant workers, or DDD workers are supplied with a contract that states they will receive a plane ticket. Doubt it. I don't think this is an immigration policy, but rather a lure to get people over here.
Immigration will simply deport you and fine you for overstaying. They will detain you until you come up with the funds. |
