Actress' Heirs to Compensate Advertiser for 'Disgrace'

A court has ruled that the heirs of the late actress Choi Jin-sil must compensate an advertiser since she failed to maintain her dignity as a model when pictures of her after a beating by her then-husband Cho Sung-min were publicized in media. A construction company sued Choi in 2004 for W3 billion (US$1=W1,250) for damages incurred and the modeling fee paid.

The Supreme Court on Thursday reversed a ruling that cleared Choi of responsibility and sent the case back to the Seoul High Court.

The company paid Choi W250 million in March 2004 for modeling for apartment buildings. The contract included a clause that if Choi disgraced the image of the company by damaging her social and moral image through her own fault, she would repay the firm twice the modeling fee. Five months later, pictures of her beaten and of the inside of her house in a chaotic state were released.

Because Choi died in October 2008 when the case was under Supreme Court review, her status passed to her eight-year-old son and six-year-old daughter. Choi's mother is acting as legal guardian.

In terms of social justice and sexual equality, Korea stands with Saudi Arabia.

I expect a similar clause is involved with many Western modelling contracts. It's obvious the construction company would attempt to get the money if they think they've got a decent chance... although they should probably drop it just for the bad press they might/will get. Especially seeing as they're taking money from the kids!

It wasn't her fault she was beaten, I presume the supreme court will chuck this case out.

Animals are treated better than this.

Anyone know what consturction company it was. I will formally boycott them and try to persuade others to do the same.

reminds me of the case (in wonju?) where 40 schoolboys gang-raped a girl for months. the judge let them all off, while the victim was harrassed by all the families to drop the case. Finally she disappeared.

Then there was the rapist teacher who was let off with a warning. I think this is a japanese news report on it, but I can't understand what the outcome was and Youtube korea have disabled it...

Ya, I don't know why the Supreme Court is sending a case anywhere, that's not how it's meant to work. Maybe it's a re-trial... [edit: looks just like a final decision. If this was in America I don't think it could be appealed. Boycott necessary!]

That's just it - in the west no company would dare sue a battered spouse over something like this, no matter how greedy they were. Here, well, they're obviously not afraid of the consequences. Do they have any western affiliates? Creating bad press for them might be the only hope of pressuring this company to do the right thing.

The US Supreme Court also returns cases to lower courts for retrial.

``The core of the case is domestic violence, which is rampant here but is rarely reported to police. Many people also think that victims are partly to blame for domestic violence. Despite such social notion, Choi, a top celebrity, disclosed her situation, and it showed that she had severe suffering and was desperate to escape,'' the groups said in the statement.

``The ruling will silence many more domestic violence victims. The court gave up its social responsibility for domestic violence,'' a director of Korean Womenlink said.
