Here's a new tax quandry for US citizens with Korean (or foreign) spouses. Actually, it might be something that everyone but me was already aware of!

2008 was our first year as a married couple. I took my time getting my tax docs/forms together this year knowing that we receive an automatic 2 month extensiion overseas. Now I find out that I can't even file taxes separately with out an SSN or TIN for my wife? This is a bit of a hitch in my plans.

I'm going to send out the extension form today, but was wondering how/what other US citizens with non-resident alien spouses did to resolve this problem in Korea, or anywhere similar for that matter? Is there something I have overlooked, or is it really a matter of going to PWC or Deloite Touche down in Seoul and submitting a W-7? I really, REALLY appreciate the help, guys!

There was a recent thread on this (do a search). PRagic (I think) suggested writing "non-resident alien" next to your wife's name. That is what I'm doing this time. Before I just left that line blank. As you don't owe any money due to the overseas exemption, I doubt the IRS would spend the resources to hassle you. There is nothing in it for them.

Here is the thread;

Dave's search function sucks

Hope it helps. File the W-7 and get your wife a ITIN. There is a link to the form in the above thread.

that's what i thought. having read the irs regs, i was just wondering if there was anyone out there who found a way around it. wish i had figured it out earlier. thanks, t-j!

writing "non-resident alien" seems like a bit of a crapshoot to me, but i'll consider giving it a shot for this round.
