I got arrested for an OWI last year. The charge got dismissed and I didnt even go to court for the charge. About 10 years ago I got a charge for possesion of marijunna and that chrge got dismissed as well.
Now I'm not sure if either one of these will even show up on my CBC but the recruiter I have been working with over the last couple months informed me that I can have a CBC ran through another state just incase something does come up on my CBC in my home state.
The recruiter refered me to a gentleman in Colorado. A state I have visited but never lived in. The recuiter and this gentleman both tell me my CBC can by ran through Colorado and I will have a clean record with the apostille which is needed. The gentleman in Colorado charges 150.00 dollars to do this service for me. Does anyone have experience with this or feel its safe and on the up and up. I havent sent him any monies yet becasue I wanted to make this post and get opnions from ppl that may have knowledge or experince in the matter? please advise and thank you all very much |

| OP that's pretty shady. I know you're just trying to figure out how to do things, and I'm not going to fault you for getting pinched for some weed 10 years ago (they gave up testing for it, but if you got arrested you're disqualified?). Then again, it's one of those things...I know I've gotten away with driving plenty of times when I probably would have been above the limit but didn't have any problem driving. It's just bad luck of the draw I guess. But overall it's not illegal to try...$150 is a lot of money if it doesn't work...that's a bit odd on your recruiter's part though. |

| Just try your real state first (it should be cheap without the Apostille) and then if it doesn't show up you're good, and that's shady for your recruiter to tell you, I'd find a new one. |

My OP may have threw you off a bit. I got arrested for an OWI in Sept of 2008. I had been driving my vehicle reaching for a cell phone on the floor and hit a parked car (yea I know pretty boneheaded thing to do) anyway when I hit the other car it gave me a concussion and I was disoriented. The officer asked if I had been drinking or taking drugs. I told him no i had not been drinking (and passed the brethlizer) but at the time I was going through a divorce, plus my sibling had just passed away within the same month. My doctor put me on an anxiety drug. Anyways I told the officer that I has been taking an anxiety med and showed him the prescription bottle that was in my brief case. They took me to the hospital then after I was released arrested me for OWI. I provided documentation from my DR that I had a legit prescription for it and it got dropped. The officer thought I was intoxicated from the meds when I actually had a concussion from hitting my head on the windshield.
The other incident was when I was in college 10-12 years ago and got charged with possesion of marijuanna. That charge was dropped as well becasue the police department infromed my lawyer atthe time that they had "lost" the evidence.
So I'm just concearned that one or both of these may come up on a CBC even though they were both dropped. Does anyone know if a CBC shows what your convicted of or what you were charged with? Is there a
difference as far as a CBC goes?

Similar situation....I DID request my state CBC and it came back w/ a dismissed misdemeanor. So yes, I was NOT charged. My concern is that when I get to Chicago and go through the interview that they will deny me the Visa. And I'm so bummed bc the situation of the dismeanor WAS dismissed and it was such a dumb situation.
You would think if you weren't charged with anything that it shouldn't be on your CBC -- it's just holding you back when indeed you were guilty of nothing. |

| There's difference between a charge being [b]dismissed[/b] and a charge being [b]dropped[/b]. A dismissal means that you were not convicted but it will stay on your record unless you get it expunged, which I believe depends on the law of the particular state. Dropped charges means the arresting authority decides not to pursue the charges. If your charges were dropped then you have nothing to worry about. If they were merely dismissed then they may indeed appear on your record check. |

I just checked with lawyer that I had at the time. This may help you if the charged was "dismmised" then it will still be on your CBC.
Like I stated before I got an OWI aroung this time last year which was aslo dismissed. Just to let you know if a charge was dismissed its still on your CBC. The only way it would not be is if the charge got dropped. Send me a PM and I ca discuss this with you in greater detail.
Its really a bunch of BS. You would think you would have to ,be convicted of a crime for it to matter however that is not the case. |
