Ok so today is my last day. Contract was terminated as I was fired. I was given one month's notice.

They said I''d be paid by the end of today but I haven't.

I've been calling but they are evading me.

I guess seeing as I have to go to immi on monday to canel my alien card, they reckong as I'm broke I'll have to just leave and not be able to fight a labour claim etc.

What do I do? I want to file a complaint and claim my salary at the Labour office. I also want to somehow get immigration to give me an extension so I can stay here whilst I wait for the claim to play out etc.

I'll be able to borrow enough to live on from friends until sept 16th and then I get 2 mil for my housing deposit back from my landlady.

That will enable me to live here for around two months.

What should I do first?

Anyone been through this before who can talk / run me through it?

Thanks

Smarten up, madoka.

I hear that they're doing this to a lot of teachers. To one, even, that gave them 2 months notice. They're trying not to pay him either. It's like they're waiting to see how you react and use any negative reactions/actions against you in order not to pay.

I've heard that even when they fire you and give you notice that if you want a letter of release, they'll try to make you sign one that states that you quit THE DAY OF THE RELEASE LETTER (ON THE SPOT) for personal reasons and not the other way around.

Do not work for this outfit.

You will lose more money than your school owes you if you just hang around Korea waiting to collect.

What you should do first is get yourself a new job. You can work, make some cash and file all your legal paperwork while you are employed in Korea. You will not be losing money while you pursue your case, and hopefully you will win that too. Win/Win.

If you hang around not working, you will earn nothing, spend more, and possibly be unable to pursue your old boss. Lose/lose/lose.

Get a new job and place to live first.

Good luck.

O.P.,

Conside this.

Show up at school asking for you pay. Keep an MP3 and record everything that is said. If you want to be so bold as to take a video of the event on a cell phone, that is up to you (it may or may not be good to do that one, though).

Keep saying that you need your final pay....keep recording.

Do NOT go to immigration to cancel your visa. Once that is cancelled, your chances of receiving your pay drop.

Best of luck.

A question about this... If I don't go to immigration and cancel the visa - does that mean I'm still in Korea legally? As long as I hold on to my alien card, irregardless of the fact I have a release letter, am I still a legal resident?

The answer to this depends on your ex-employer's action (or lack thereof).

Not necessarily. The onus is on you to contact Immigration re: your period of sojourn. They have no obligation to contact you.

If your visa is cancelled the date on your ARC is meaningless.

Well, if your boss is tight with someone at immigration then he/she can cancell your visa without you being there.

Illegal, I know. But it happens (unless, it IS legal).

I still say you show up, ask for your pay, dont' leave and record everything on an MP3 or a cell phone......

...then post it for the rest of us to see.

Well I got paid and release letter int he end and 30 day exit order.

Everything I wanted.

But they tried every dirty trick inthe book andluckilly my 5 years experience put me in good stead to counter them. Had I have been a newb I'd have gotten badly screwed over.

They are Win Education - new name EdUp.

I'm busy jobhunting now but you can expect a full, detailed account of why they are a bunch of scumbags.

Bizarrely when I went there to protest for my salary I met one other guy who was getting the screw over job and he is also in contact with one other guy who they're trying to roll over.

another word of warning for newbies.......avoid this company. This company has come up on numerous occasions on here for skechyness, late pay and in particular the double bank book scam.

I'll vouch for that as well. Same thing happened to me, though I didn't get fired early and screwed out of my pay. Other things happened that got me in trouble with immigration. By the way, what's the name of the foreign teacher handler? Would it be someone named Kim?

I was at immigration with them on Monday as well to cancel my visa cause they illegally broke my contract. Now they are not paying me my salary until they find a new tenant for my apartment. I have contacted the labor board and a lawyer here in Korea who is willing to help me. Your story might shed a lot of light on my situation. Please contact me or anyone else who has experiences with this company. You can e-mail me at [email protected] I can not reply to pm cause I have not posted enough on Daves. I look forward to hearing from you DWAEJIMORIGUKBAP and others who have stories. P.S. Deana who is the manager over there is out of her mind and the CEO well he is the same.
