This is the contract my spouse and I received recently, it seems pretty short so we're a little skeptical. Any advice would be great.
This employment contract has been made between___ (hereinafter referred to as "The Academy") and a national of the United States of America, ___ (hereinafter referred to as "The Teacher"). Both parties agree on the following terms and conditions.
1. Purpose of this Contract
The Teacher agrees to teach students at the time and place designated by The Academy and is actively encouraged to develop the curriculum. During the term of this contract, The Teacher must strictly comply with all The Academy's polices and guidelines.
2. Period of contract
This contract is valid until Nov 19, 2010 starting from Nov 20, 2009. If both parties are in agreement, the contract may be renewed at the time of completion.
3. Working Hours
Office hours are from 3pm to 10:00pm weekdays and 1pm to 7pm (1st and 3rd Saturdays) / 8:30 am to 3 pm (2nd and 4th Saturdays) on Saturdays. During students� summer and winter vacations, approximately 30 and 50 days respectively, office hours are from 8:30am to 6:10pm weekdays and Saturdays. The Teacher will stay at The Academy during working hours, work according to The Academy's schedule and follow any schedule changes which may occur within working hours. The Teacher is expected to devote time for lesson planning with co-teachers, student evaluations, syllabuses, report cards, correcting compositions, supervision of play, workshops and staff meetings without additional pay. The Teacher agrees not to teach at other institutes without the express permission of The Academy. The Academy can demand that The Teacher be transferred to another branch owing to unavoidable circumstances of The Academy.
4. Accommodations
The Academy will provide The Teacher (______) rent free housing with furnishings which are a TV set, air conditioner, washing machine, refrigerator, stove, bed, and closet. The cost of monthly service or management fee and all utilities (electricity, water, gas, etc.) will be paid by The Teacher. The Teacher can have his or her own telephone, cable, and Internet services registered by his or her own name and pay the bills.
5. Salary & Overtime
A monthly salary of ₩2,500,000 will be guaranteed for 130 teaching hours a month (one hour is 40 minutes). The salary will be paid on the 7th of each month. Each teaching hour in excess of 130 teaching hours is considered as overtime. The overtime pay will be \17,000 per teaching hour.
6. Tax
Income tax (4.4%) will be deducted from The Teacher's salary in accordance with the Korean law.
7. Airfare
The Teacher�s round-trip airfare is covered by The Academy. The Teacher shall receive a return ticket back to their original point of departure upon successful completion of this contract.
8. Holidays and Vacation
All Korean holidays will be observed and The Teacher will have 10 days paid vacation according to the Academy's schedule. Normally 4 days paid vacation is fixed for summer (between the end of July and the beginning of August). But the schedule can be changed according to the Academy's schedule.
9. Severance Pay
Upon completion of this contract, The Teacher will be given one month salary (\2,500,000) as a severance pay. This payment will be made at the time of completion of the contract period.
10. Compensation for the termination of the contract
If The Teacher wants to terminate this contract, The Teacher has to inform at least 2 months before. If The Teacher wants to terminate this contract, he or she has to not only relinquish his or her return airfare, but also compensate for recruiting fee for a new teacher and his or her one-way airfare to The Academy. If the termination is due to The Teacher's faults (for example, crime, violation of Korean law, drug abuse, definite negligence at work), The Teacher also takes responsibility for the damage to The Academy.
