Hello,

I would greatly appreciate some sound advice. Tonight my boss informed me that she won't be paying me till the 21st. My paydate should be on the 10th. I've heard that employers have 10 days to pay before they've officially broken the contract. My contract doesn't include any language about this, though. It just says that my pay day will be on the 10th of the month.

I recently received an offer to teach at another school through a Korean friend and am wondering... if my boss doesn't pay me until the 21st, am I free to go?

Thanks in advance for any advice =) I could really use it!

You're always 'free to go'. The question should be -
"Can I (legally) work for another employer?"... and the answer depends on many variables (but, probably not).

This is the reason your pay date should be on the last work day of the pay period, not even one day later. It's also the reason another long-time poster suggested one must always be prepared to pull a runner.

I'd happily tell the boss that I'll be returning to work once my pay resumes on time. Let's see how quickly her financial troubles disappear then!

I believe pay has to be at least a month or two late before you can take legal action. I'm not 100%...this info is from years ago.

I'd not worry about it yet, unless you're broke and diving into dumpsters for food. Dumpster diving always calls for a meeting with the boss.

You have to be direct with Koreans. No PAY No Work. If not just walk. Tell them upfront. That is it! You can't be flexible.

I'm like that with my public school and now they are renewing my contract.

I doubt you're getting renewed because you're showing them how tough you can be. It probably has more to do with how entertaining you are in the classroom. Fill those seats and you get renewed.

Public school classrooms are already filled, regardless of the caliber of the NET.

If they pay you one millisecond late it cancells all the contract clauses and you get a million dollars and pass go with your 200$ intact. Happy travles.
