New contract during current contract

So the school I work for wants to give new contracts to all teachers (including native teachers) by the end of this month. Can they do this? What will happen to my current contract? My friend was saying that if I decline to sign the new contract or ask them to change things, they may fire me (contract states that I can be terminated by them at any time). Would it actually come down to me being fired or signing the new contract? I've been here for 2 months now, never had one complaint, and treat all my superiors with respect. Their excuse for giving us new contracts is because the Korean teachers do not have contracts. They want everyone to be treated equally and fairly, so everyone will be receiving almost identical contracts. Can I do anything about this?

is it a big deal? The questions i would have for your boss are:
1) does my contract change? (bonus/hrs worked/money/living/flight/EVERTHING AND ANYTHING)
2) do i need to get a new visa?
3) if yes, who pays for this?
4) seeing as you have been here for two months is your new contract 10 months or 12?

Legally they can not do this, but if teachers go along with it then they can.

I'm not saying they won't fire you for not signing, they might. But you'd probably be better off getting away (far away) from any employer who tries to pull this kind of BS.

Just say no and see what they do.

In the long run, you will be better off not working for them.

You already have a contract, you haven't seen what they are proposing (or if you know what's in it, you didn't tell us), and you don't have to sign a new contract.


You should let them know that you already have a contract and you are reluctant to sign a new one. If you get the chance, it would be good to let them know in advance.

If they bring a new contract with you, you should take it away to read it over before you react.

You should then read it, think about the changes, and see what effect they actually have on you.

You will then have to choose whether to:

1) accept some or all of the changes - although this might be better handled as an addendum to your current contract instead of a new one. There could be dangers in having a new contract with a new signing date. You might make an addendum change if there is only a small change that you don't mind. Perhaps there are even trade-offs.

2) politely refuse and insist on continuing under your original contract. This could cause bad feelings, especially if you are the only one, but it is your right NOT to sign a new contract. If you choose this option, you might want to do this in private, quietly and calmly, and tell them how you really like your job, but you counted on the contract as it is etc.

3) quit, be prepared to quit, or be prepared to be fired. If you think that the new terms are so bad versus what you had agreed to, then you should take a stand.

Is this a P.S or a hakwon?

I'm guessing it's a hakwon as most P.S. contracts give 30 days for termination. If so, then the poster ontheway has the best advice in the thread on how to handle this.

The school I'm with is a hagwon. They haven't shown me the new contract and told us (all the workers) that those with contracts will be talked to individually. My current contract states 1 year (12 months). It also states that if I am fired, I will be given 30 days notice (same as if I quit).

I think they might say that if I sign the new contract I can still finish by the end date on my original contract. But doing this may let them get away from having to pay my severance. If this is the case, I won't be signing anything. Thanks for the help guys. If anyone else could help out as well, that would be great.

I guess you can't really get upset about it until you see what is in the new contract. Maybe the changes will be good for you. Maybe they will be bad for you. Once you see the new contract then you can decide how to react.

My old hogwan also asked all of us to sign new contracts at one point. Actually it wasn't really even a new contract it was just an addendum to the existing one. They just wanted to add four more classes per month to our contract hours. But they were honest about it and adjusted our pay accordingly. In a situation like that it's not really worth it to get all huffy puffy about it.

If, however, they make major changes that are not good for you then I would suggest that you fight it.
