If you put in your notice and you intend to stay to stay 6 mos, i heard they cannot take out airfare by law. (The one way that got u there). Is this true?
If so, can someone please provide a link stating where it says this so i can back myself up?
thanks!!
ps this would be on a one year contract, things just not workin out and u put in ur solid 2 mos notice ur quitting |

If you have served 6 months, then airfare should not be required to pay back.
Check the contract. |

There is no law on this. It all depends on what your contract says. If your contract requires repayment up to 6 months, then after 6 months you don't have to repay. But if your contract requires repayment up to 8 months, or even a year then that's the way it is. |

| Would people please stop signing contracts that require repayment after 6 months. It is a form of fraud by your employer if they require repayment after this time. |

Back in 2000 or thereabouts it was standard for many hakwons to say that you don't need to pay back the initial airfare after six months. Still is for good ones.
But there is no such law that states they must do so. If you can get this in your contract, then all the better...but there is no law forcing them to do so and it is completely legal to ask for repayment at any time if you don't finish the contract. This of course is subject to what your contact says. |

Yes it is legal, but it isn't moral or ethical (hence "form of fraud") to require repayment after 6 months, if people don't sign such contracts the problem will end.
Actually I belive airfares should be pro-rated from day one, you spend 1 month here then you repay 5/6ths and so on. But that would require a knowledge of business that doesn't always exist in the Hagwon world.
If hagwons started being reasonable then the rate of running would fall. Running is a cost of business for hagwons, obviously the rate should be kept low but it will never ever be eliminated. |

Bigfella, you may need to look up the definition of "moral" and "ethical." Your post smacks of entitlement, and you paint your position as the "right" one. It may indeed be the one that you like best, but that doesn't make it right -- even if you use terminology denoting right and wrong.
I could argue that it is moral and ethical for schools to be repaid for the cost of hiring a replacement teacher -- and that this cost is also pro-rated starting on day one -- if you cut out at the 30 day mark, you only have to pay 11/12ths of the fee for getting your replacement processed and flown over. If you've taught 10 months, you only pay 2/12ths of the cost....
A fair, defensible, unpopular position to take, since it would protect the schools rather than the teachers, but just as "moral" and "ethical" as your position that teachers should take no responsibility. |
