Before they are diagnosed, they are not putting other people at risk, only themselves. Further, the risk in question is often vague and remote in their mind; most people who get HIV through the type of behavior you're describing never really believed they'd get it. They never really understood the risk.

After being diagnosed, they are now putting other people's lives at risk, and more importantly know for a fact that they are. There's nothing vague or remote about the risks they would be subjecting others to. Further, their actions can now carry criminal consequences.

I'd say the two situations are thoroughly different, and the fact that someone may have contracted HIV because they were careless doesn't imply they'll continue to be careless when they know that other people's lives will be destroyed by their carelessness. Showing lack of regard for your own safety, and showing lack of regard for the safety of others are different behavioral types. In this case, it's the difference between taking a risk, and what amounts to murder.

Finally, don't you think contracting something as seriously as HIV can serve as a powerful wake-up call? You keep talking about how people who contract HIV will behave, but I'm still waiting for statistics on the % of people who remain sexually active after being diagnosed with HIV.

I'd like to see data on that too.

Fox, you might want to google "bug chasing" and "gift giving". Things aren't as rational as you or I might like.
