Folks, my boss is trying to say that he won't pay me my money until after I've left... Which is not at all what I want to do because i don't think he'll pay me at all. In fact I recently found out he was ripping me off on pension and forced his hand on that.

He's saying that to pay me in advance is a 'breach of contract' because our contract says I get paid on the 10th, so my payment will come on the 10th of the next month after I'm gone.

My roommate left before me and after she left he started deciding what he 'actually' owed her and made a few deductions which were total bull shit and not at all what we agreed upon.

Is there anything I can do to force him to pay me before I leave?

You're due any moneys owed BEFORE you leave the country. Just point out that you're at the end of your contract. The labor board IS your friend.

I also (politely) asked if they could pay me it in advance. When they said no, I got more insistent.

Later they come and tell me that my phone (which is on their plan, I ust pay him my bill directly) is getting shut off today. I get no time to call my family or friends, they just shut it off. I am still at work so I haven't had time to confront them about this yet.

Well technically they have a short while to pay severance. Can't remember exactly, couple of weeks. I found that out lasy tear when was after being paid on leaving.

It may be worth makiing noises like u r coming back soon (implying that you will be in country to deal with discrepancies).

Your boss doesn't pay you your pension, you will need to go to the pension office in your area and show them your plane ticket as proof that you're leaving as well as give them your bank account information where the money should be sent. To be on the safe side have your account number and the banks address and phone number as well.

Looks like he isn't happy with you at all if he just turned off the phone. Maybe you can stick around until the 10th to be sure you get your money. Oh, and I would also be sure to move anything important (passport, degree, things of value) to an apartment that your owner does not have access to.

I am not a chicken little, but that whole shutting of the phone thing is pretty crappy of them. Who knows what they might do next.

Pension is retirement pay. That's pretty much the definition of it. Are you talking about severance pay?

I posted this on another board but this is the original one and more appropriate.

My boss wants to pay me my final check and severance after I leave, but he did that with my roommate and didn't pay everything.

Everyone here has told me he has to pay me in advance before leaving, but I called a person at the labor board and they said he has 14 days after my contract expires. Anyone have anyway to prove this one way or the other?

There was a huge screaming fight today over almost nothing. They've tried to get me to resign before and were always talking about how great of a teacher I was, but now they're saying that I'm a piece of shit and they are not going to pay me my retirement fee.

Oh well, looks like the labor boards are going to have to sort it out.

i'm having the exact same issue right now. i'm done in 3 weeks, but i won't get my severance until i've been gone for 2 weeks. my visa will still be good and i could stick it out at a friend's place. i'm just wondering what would happen in terms of my plane ticket (how to reschedule it, what if my vindictive boss cancels my flight, etc). lots of fun!

Severance/retirement/whatever pay is supposed to be paid annually, at the end of the 12th month of employment. Even if your contract was extended by two months, you still should get it then, which in this case means two months ago.
