I'll keep it short. I have been working with Win Education for the past 11 months since March 2008. It's coming to the end of my contract and I want to make sure I don't get screwed around with severance and final paycheck. Since I am flying out of korea on monday march 2nd and my final day teaching is friday 27th feb i wanna make sure everything is paid as expected on the last day of work, because if it isn't then I wont have much time to get my money.
Main concern for me is that on my contract the dates go from 10th march 2008-9th march 2009. However my visa expires on 28th of february. I asked my company about this and they have informed me that I am my last day of work is fri 27th of february. Therefor I'm wondering can they get out of paying me severance if I don't work until the last day of the contract(march 9th)? I'm not sure what the law is with severance pay, do you have to work an exact 12 month period or is it fine finishing one week before as in my case? |
(Not related with Win Educ but...)
My contract finishes March 15th, but my last day at the school I'm contracted with (via the after-school company) is at the end of this current term, February 26th, due to loss of government funding. This was news to me, and I emailed my company coordinator about my exit/airfare/severance/final pay etc.
This is where I don't agree and need advice. She confirmed this, and says that after I finish at my school, she wants me to work at another school and do some teaching and administer some level-tests for the 2 weeks that I would have been working at my current school.
Is this right? My contract states that I work at my current school, no mention about other schools etc., very specific. There isn't anything about the circumstance I'm dealing with now, shortened hours because of an ending program.
My initial reaction is that I don't feel like I'm obligated to work at this other school to finish the remainder of my contract. At the same time, I just want my normal final months' pay, severance, and airfare, and be on my way! Since the school pays the company, then the company pays me (had no problems whatsoever), what do you guys think? I feel like a restricted free agent... |

you have a contract until March 15th and you dont feel obligated to work for the 2 weeks to Finish your contract?
Um, do I even need to elaborate on how that sounds?
I do not think the process for this is very hard, its as little as going down to immigration and getting your crd changed for 2 weeks, or you may even be fine if you are contracted for a certain company ( not the exact building that youve been working in for the last x months) |

I understand your point (don't know about the fines though...), but my thinking is this... if my school is gonna pay me the full months' pay and everything like that, even though it's half the month... i feel like my recruiter feels like they can take advantage of this opportunity because i'm suddenly available. no? |

But if you won't be working for the school then they probably aren't paying that last month. If they are, then yes, the company may be using you in a way, but no reason to think that you should just get the money without doing anything. |

It is two weeks. Just do the work. You risk them pulling technicalities on you so they don't have to give you a pension. I would just avoid the drama to the work and get paid for it. |

Please pull your head out of the sand, if the OP has paid pension and the school has matched each month then he/she should receive no matter what. Severance is another matter entirely. |

No maybe not, but that doesn't mean the school will be willing to take the necessary steps to make it legal. What isn't "very hard" and "legal" are two totally different concepts here. My thought is that there is no way in Haiti the school will go to Immigration or provide the documents for the OP to make the final two weeks legal.
OP, I'm guessing that you work for an after school program which means you're probably a "Freelancer" in the eyes of the sorry tax ministry who must file and pay taxes yourself, goodluck. If you don't receive vacation like most public school teachers and have an E-2 visa then you have to get the permission of Immigration to work at another school/address of school or whatnot put on the back of your Alien Registration Card. If this isn't done you are teaching illegally and subject to deportation/fines and your school doesn't care since they aren't supporting your visa.
Call ANTI-English Spectrum, they supposedly care about "right" English. By the way, does ANTI-English Spectrum provide a phone number for Native English Teachers to call and report "wrong" English?" |
