my contract makes no mention overtime, only mentioning the work hours of 9-6. a good thing? |

CLAUSE 1 (APPOINTMENT)
a. The employer agrees to employ the teacher during the period stipulated herein.
b. The teacher agrees to accept the employment and will work in his/her full capacity for the school.
CLAUSE 2 (PERIOD OF EMPLOYMENT)
a. This contract is valid until Feb 28th, 2011 , starting from Feb.28th, 2010 .
b. The teacher must inform the institute if he/she would like to renew one. It has to be done 2 (two) months prior to the end of the contract period. Under the mutual agreement of both parties, the contract will be renewed.
CLAUSE 3 (THE EMPLOYER�S RESPONSIBILITIES)
a. The employer and teachers are equal individuals working together to provide quality English instruction under the terms stated in this contract.
b. The employer will honor the terms and conditions of employment for the teacher as stated within this contract.
CLAUSE 4 (THE TEACHER�S RESPONSIBILITIES AND DUTIES)
a. During the terms of this Agreement, the teacher must cooperate and comply with the instructions and disciplines of the school. Assisting the Supervisor he/she must carry out assignments as directed by the employer. The Supervisor will be responsible for establishing and communicating the Standards of Performance as related to the duties stated in this contract.
b. The teacher must have adequately prepared for the classes in advance.
c. At all times during the term of this contract, the teacher must maintain a clean and neat appearance.
d. The teacher�s work will include the following:
①. Teaching the English language
②. Development of educational programs and materials
③. Indoor and outdoor classroom activities for/with students
④. Grading, evaluation, and assessment of students
⑤. Providing students with individualized care
⑥. Providing lesson plans on every third week of the month
CLAUSE 5 (WORKING HOURS)
a. During the term of this Agreement, the teacher should work in cooperation with the teachers of the school Monday through Friday, from 10:00 a.m. to 6:00 p.m. However, the teacher is expected to arrive at 9:00 in order to prepare for classes.
b. The teacher will be required to attend some special events throughout the year (workshops, graduation ceremony, etc.)
CLAUSE 6 (SALARY)
a. The payment of 2,300,000 won minus 3.3% (taxes), minus 4.5% (pension), minus 2.1% (medical) is to be made on the second day of the following month. (Total deductions= taxes (3.3%) + pension (4.5%) + health insurance (2.1%) = 9.9% of total monthly salary.
b. The salary for teaching is inclusive of actual teaching hours, lesson planning, test preparation, vocabulary list building and school outings. Furthermore, all teachers will have a scheduled block of time to plan their lessons each day.
CLAUSE 7 (ABSENCE / SICK DAYS/ TARDINESS)
a. Any absence without notice in advance will result in a 100,000 won deduction from the employee�s monthly salary.
b. Every (1) hour missed without notice in advance will result in a deduction of 30,000 won from the employee�s monthly salary.
c. Three consecutive days of tardiness will result in a 100,000 won deduction from the employee�s monthly salary.
d. A total of three (3) sick-days a year will be given to the employee as long as a doctor�s note is provided and confirms the actual sickness.
CLAUSE 8 ( VACATION & HOLIDAYS )
Paid vacation and National holidays.
The employee will receive ten days paid vacation (5 business days in the summer & 5 business days in the winter) exclusive of the weekends prior to and after the vacation period.
During the aforementioned holidays, the employee's basic salary amount is still paid without any deductions.
CLAUSE 9 (DISMISSAL OR VOLUNTARY RESIGNATION )
a. The employer reserves the right to dismiss the teacher from employment for the following causes:
①. Neglect or inability to perform his/her duties stipulated in this agreement.
②. Frequent absences from work.
③. Unexplained absences will result in termination of agreement.
b. The employer agrees to give the employee 20 working days notice in the event of dismissal. However, in the case of a teacher�s criminal behavior or misconduct, he/she will be dismissed from employment immediately with no warning or notice.
c. In the event the teacher resigns from employment, he/she can do so by giving 40 working days notice to the employer.
CLAUSE 10. Completion Bonus (Severance pay)
Upon completion of the full 12 months of employment the employer will pay 2,300,000 for the completion bonus. Also, a return flight ticket will be provided. If the employee does not follow Clause 4, 5, 7, the severance pay may be cancelled.
CLAUSE 11. Housing
a. Rent-free accommodation. The employer will provide the employee with a rent-free officetel.
b. The items included with accommodation (free of charge) will include the following: a bed, a/c, dishes, and a dinner table.
c. Utility costs. Utility costs (water, gas, electricity, cable tv, internet service and maintenance fees) will be paid by the employee.
d. Any item(s)i.e. furniture/machinery lost, misplaced and/or damaged will be the employee�s responsibility to replace.
e. Pet(s): The employee will be held 100% responsible for any pet(s) he/she may have, including the fee of a 50,000 won a month fee paid to the property owner.
Clause 12. Insurance
Insurance will be given to the employee and will be split 50/50 (employer/employee pay 50% each), as long as the contract is valid. The cost for the insurance will be 4.2% of the salary per month (2.1% paid by employer and 2.1% paid by the employee).
Clause 13. National Pension
A national pension will be given to the employee and will be split 50/50 (employer/employee contribute 50% each), as long as the contract is valid. The contribution will be 9.0% of the salary per month (4.5% paid by employer and 4.5% paid by the employee).

clause 10 is a bit iffy but apart from that it all looks good...(a teacher has told me that his officetel came with a lot of stuff, including things like a toaster, so im not too worried about the furnishings, that is taken care of). |

You may want to ask for more details on clause 10 before you sign - whether documentable warnings will be given if such breaches in behaviour are noted, etc. It sounds like a convenient way to squeeze out of paying a bonus at the last minute, otherwise.
FYI though, there's a contract review thread that you might have better luck with. |
