He is correct. There is no law to support you in this case.
Edit: Unless visa runs are in your contract, then he's contractually obligated.

Although your boss was wrong in that you cannot get a multiple re-entry permit at the airport, only a singe re-entry, I don't see how any of this is his fault. It is your responsibility to make sure you have a valid re-entry permit when you leave the country, not his. You should have checked your permit after receiving it.
As far as I know, there would be no laws that deal with this. As airfare is a contractual issue, not a legal one. If it isn't mentioned in your contract, I don't see you having a chance a getting the visa run paid for. |

Here's the story.
I got my E-2 visa transferred from one place to another as we can these days, then went on a one month break out of the country between contracts.
I asked them (my new boss) to apply for a multiple re-entry visa in Seoul, but they didn't and said I can get it at the airport.
I applied for re-entry at the airport but didn't notice the expiry date stamped on was before I intended to return (the immigration guy must have made a mistake).
So when I returned (after the re-entry permit had expired), my E-2 visa got cancelled. Had to reapply, but luckily have everything and will be going to Japan.
My director wants me to pay for the visa run because he thinks it was my fault that the E-2 visa got cancelled. I disagree with this, but he does have a point (technically, I did enter after the permit had expired).
I wonder if I should have to pay, even if it was my fault.
Shouldn't the director pay regardless? And decide whether to hire me based on the fact that he has to pay?
Is there a precedent for this? Has any foreign teacher had to pay for their own visa run before? Does anyone know the law? |
Schools pay for a visa run when they bring you in without a work visa, process you here and then you pop over to Japan to get your visa.
This is NOT your case.
You were here and had a visa. Through an error on YOUR PART you got your visa canceled. It was not a business related trip so your boss should NOT be responsible for your predicament nor should he be responsible for the costs of obtaining a new visa.
If HE screwed up then it would be his responsibility to pay for it.
BUT....
You screwed up - you pay for it.
