|
I am leaving Korea in the next couple months and am on good terms with my Hagwon. I originally signed a one year contract, finished it in November and got my one year severance added to my check that month. They also flew me here and back for Christmas last year.
I decided to stay for another 6 months just so I can go home in the spring. Anyways, my hagwon director gets pretty stuck up when I mention money so I wanted to get my facts straight first.
If I worked 6 months, am I entitled to half severance? Half-airfare home?
Just curious. |

Airfare is strictly a contractual matter. It is what you agreed to in writing when you extended your sojourn/contract.
The severance is a matter of conjecture and some confusion.
The LAW states that you get 1 month's salary for each FULL year worked ergo, no severance for the partial year..
HOWEVER
On the ministry of labor website, in the FAQ section there is this specific question and they state you are entitled to the extra 1/2 month salary for the extra 6 months of work.
If you take it to the labor board in a fight, I don't know who would win and I am not certain how the policy should now be interpreted.
I guess I am trying to say that there is NO certain answer to either of your questions.
sorry. |

The way it was explained to me when I started my public school job was that it depended on whether or not you received your severance at the end of the first year. If you received the severance after your first year, the clock resets. So you would have to work another year to be eligible for severance. If you didn't receive your severance, then it would be prorated. So since you already received your severance, you wouldn't be eligible for severance for the extra 6 months you worked. |

This situation is exactly true for pension. Perhaps you are getting it confused? I've heard that severance is only done when successfully completing a one-year contract, thus after six months you wouldn't be eligible. But pension works exactly as you described. |

There is a CERTAIN and legal across the land answer. Koreans know it, I know it from contacting the labor board and verifying.
If you complete one year, all subsequent months are prorated and severance is calculated by a formula / day.
I posted this here previously. You just have to read some Korean to know the answer. So,
1. Work less than a year for one employer = no severance pay
2. Work more than a year with the same employer (even if you somehow got severance and cashed out) = severance pay for any days thereafter.

No, I'm positive it was severance. The way I understood pension was that it's yours no matter how many months you completed. Also, you cannot collect your pension until you leave Korea, so you wouldn't be able to collect your pension even after a year if you extended your contract. |

Here's my situation,
I completed an 18 month contract at a PS. After 12 months I got severance. After 18 months, I re-signed, but moved to another school. My old school now says my severance for the 6 months is carried over to my new school, and they will pay 1 year's severance after 6 months here.
This sounds strange to me.
Any ideas? |

What does your contract (with the new school) say? |

Oh this is a pertinent thread. I worked a year at a hagwon and collected severance, and afterwards re-signed for another year. Im going to leave the contract after 8 months..so in theory Im eligible to receive 2/3 of another severance? Id like to hear more from people who've been successful with this.. |
