Hey guys,

So here's the story and i apologise for its length and spelling mistakes. Im writing it at my school desk in a mission impossible fashion....the teachers are watching me as i type.....eeek.

I've been at my school for 5 months and the first 3 were fine. In the last 2 however 2 teachers have been fired due to 'finanial problems', didn't stop them buying loads of guff for the school including as big fancy photocopier.

ANYWAY

Another teacher has now been 'asked to leave'. When she did her health check when she arrived 4 months ago, they found something. So she was told she would need treatment. The school knew about it from the start, she got her alien card and they promised to help. 4 months later the boss has refused to give her medical and has practically thrown her out.

Since, we have found out nobody at our school pays national insurance, pension and I'm pretty sure that's. hmmm ILLEGAL!!!

It's the whole thing of, they put her on the insurance, they have to put all of us on. There's a million different things going on in this school including tax evasion etc etc...

My issue is that i now want to leave.

The other teacher with the health issue is a really good friend and we came to Korea together. She is now getting another job and she will then sign another years contract. My contract finishes in November. I DO NOT want to extend here and the likelyhood of me getting a 6 month contract are, well, slim.

So i wanna go. Also because they are a bunch of b%&s%!S!

MY QUESTIONS:

1. As ive only been here 5 months, what are my rights?

2. I want to work my 2 month notice so that will take me into 7 months, will this help with any way. Ive read about not having many rights before 6 months in the country?

3. If my boss fires me on the spot and i leave the country. Do i have to wait till my year is up on my visa before i can get another job?

4. If my boss gives me my letter of release, how easy is it to transfer to another school.

5. Should i, and the other teachers if they wish, go to the labor board????

Wait one more month, so you've got more rights.

As for medical, go to the labor board after the 6th month to "check why it's taking so long" for your boss to get you the health insurance document you need. Also, ask if they'll "check" on how much you've got in your pension, because you are curious.

Before 6 months have passed in your contract, you're "probationary" and have NO RIGHTS. Stick it out. Trust me on this.

and maybe if the OP stopped trying to play a Tom Cruise roll and just go to a PC bang to hammer out the complaint in private it could be more readily accepted.

but maybe living out a tom cruise fantasy of being ogled by a bunch of foreigners is a drea, come alive. Wink

The labor board does not "check" on pension. That's what the PENSION OFFICE is for.

It sounds more like Get Smart than Mission Impossible.

Back on topic... OP like another poster said, wait one more month. With 6 months, you have a lot more rights.

If you give notice, then the school will just shaft you. Pay deductions, and maybe even being fired on the spot. If the boss talks about letting someone else go, then you can always volunteer on the condition that they give you a release letter and help you to transfer your visa to another school. You can say that it's because you want to be noble and your co-workers need the job more than you do, so you're willing to take one for the team. If you're school is willing to work with you (in exchange for you willingly leaving) then it's no problem at all to get your visa transferred to another school. Otherwise they can make it difficult for you.

BTW, if you do report them for doing something illegal, then you're not only getting them in trouble but you're setting yourself up for a serious confrontation with the school owner. They will likely do whatever they can to make things difficult for you. Yes, you can continue to report them for whatever else they do to you, but it's going to be difficult and expensive for you to pursue them legally. So, if you can get a transfer to another school, then wait until AFTER you have transferred before rocking the boat at your current school.

The Pension Office is far better at what they do than the Labor Board is. The Labor Board is powerless. The Pension Office has the authority--and they do use it--to take money owed and even to fine.

Yep.

However, even though they have no power to fine anyone or to enforce their orders, their rulings are useful if you actually go to small claims court. A court case WITH a labor ruling in your favor is pretty much a rubber stamp win for you, whereas a court case without one is touch and go.

Yes, KubelHomer, I couldn't agree with you more. PatrickBusan thinks he knows everything--he is a "Master of Korea," a true Korean apologist, and loves to get into everyone's thread and give his unwelcome 2 cents. Any Westerner that apologizes for Korea is a traitor. It means you didn't get along in your own country, so you hate it, and now, PRAISE GOD, you finally found a country that can tolerate you. Pretty pitiful.

Getting back to the thread, if I were you I would go to another school like I did. When I started in a hagwon and they gave me crap about living with my then Korean girlfriend (she's my wife now) I quit, went to another bad hagwon, then got smart and went into the public school. Public Schools have far, far fewer problems--and they pay on time!
