Wylde's case is a good example of when money SHOULD be exchanged. It places a serious impairment not only for the enjoyment of his life, but he could have lost his job, enjoyment with his family not to mention months of rehab which is painful and unwanted.

I have no prob with settlements in that type of case

But the taxi driver pretending to be hurt....makes me quite angry.

Maybe you have no problem with it because the poster is an Aussie. Litigious Aussies are okay but litigious Americans and Koreans are scum. Because surely no Aussie would ever think of abusing the system the same way all Americans do.

I hate to make generalisations but you know that America is the most litigious society in the world.
Such cases where the boy didn't learn to play piano when he was young so he sued his parents for lost earnings and WON the case is an example of the ridiculous levels that suing somebody has got to in America.

I'm not saying there aren't some tricksters in Australia as well(I know of one person who fell down in the same Woolworths where i worked 3 times in the same year - i mean come on and won) but sometimes you've got to wonder about Americans and suing.

For the record.....I'm not an American basher, never have got in any of the anti-Us or Canada posts, just stating things as i see them.

Yes, frivolous lawsuits have been a problem in the US, but a lot of courts are wisening up to that fact...Receiving money from insurance companies is such a hassle, though, so many people just take an out-of-court settlement. Unfortunately, there are those who make fraudulent or exaggerated claims in an attempt to manipulate the capitalist law system. In my experience, however, for the most part, people expect large setlements, but end up with just enough to cover the medical expenses.

I knew one girl who got a settlement after a motorcycle accident (a teenager hit the motorcycle that she was a passenger on with his car). It was enough to buy a car and few other things (which she probably could have used for surgery to completely fix the scars and road rash). She still had some problems afterward, but no money to cover them with. Then she eventually wrecked the new car...some people just bury themselves in ignorance and choose to live for the moment...

I think the system is practical, but there are some Mr. Burns's out there who think of themselves and easy money first. However, it's foolish to say that Americans love to do that or whatever...Sure, we may be happy for someone who gets a god setlement, but the majority of us hate those who try to milk the system. Anyway, insurance companies suck, and I take pleasure in knowing that Joe Millionaire Insurance Swindler may have to give up that new yacht so Average Joe Lucky can get a months worth of beer money and rent-to-own electronics

Between an overabundance of highly educated lawyers and the insurance company system ripe for the pickings.. its no high coincidence that lawsuits of the most ridiculous kind can happen freqently in the U.S.

Also, thats one country, where people seriously know how to 'work' the system.. Americans seem to have that gift.. of course we all have higher insurance rates to cover it.. but hey, whatcha gonna do?
