Sorry I know this issue has been discussed, but i've been reading through threads and am getting two different points of view . .

I want to know if a USA state background check 'apostilled' or authorized at the Consulate/Embassy in Seoul is enough OR do I really need an FBI criminal record check?

Also - I'm trying to prepare all my documents for the work VISA at a university - can anyone point me to a thread that lists all the documents needed? I want to get things ready before deciding on the school . .

Apostilled state criminal background checks suffice.

apparently they just changed that requirement. You need a Fed background check now.

You mean changed it in the last couple weeks? Because I was just issued my immigration number yesterday with a state check.

But hey, who knows?

Looks like it isn't going into effect until the end of August/beginning of September. Even then, it will probably be a "soft" enactment, where they pick and choose who they want to enforce it on. Laughing

IMO, a Fed check is pretty simple to get and not that expensive. Only downfall is you'll have to wait a bit. There's a number you can call for the estimated wait time.

Others have stated the Federal check will be necessary by the end of the summer . . . problem is it takes 2-3 months from what I've read . . so alot of schools/immigration will need to work around it and go with the state check.

Where, other than Dave's rumor mill, can someone find this information? A link anyone?

immi's website isn't updated yet, but you can call immigration and ask how it would affect your situation (if you're in-between/will be in-between jobs).
