I'm working at a hagwon, the name of which I will not specify, and I've recently found that my employer is committing pension fraud, and I have reason to believe she is also committing tax fraud.
I am having 5% deducted from my pay each month for "tax," as per my contract, but nothing for my pension. After contacting the government pension office, I found that my reported monthly income is 85000 won, and my pension account is somewhere in the vicinity of 60000 won.
I'm also not receiving any official pay stubs, though I am being paid consistently on time.
I plan on filing both pension and tax returns, but I'm not sure at this point how to go about ascertaining that I will actually get the correct returns. I was told by the pension office that I need to speak to my boss about the error, but when I asked her about getting my pension, she said she would send it to me after I go home (translated by Korean co-worker as "you're never going to see any of it").
Short of telling her directly "you're commiting pension fraud," which would be very bad for my severance pay, how should I go about confronting my boss or getting the authorities involved, or whatever is necessary to get me the money my boss owes me, without jeopardizing my relationship at the school (I still have 6 months left on my contract, and I'd like to stick around for the time being, I kinda need the money for grad school).
Also, is there a way to check that the "tax" that I'm having withheld is actually going to tax, and not to my bosses pocket?
If you're just going to say "you're screwed," don't bother answering. If you want me to march in and yell at my boss, don't bother answering. I'd welcome advice from anyone that has decent knowledge of Korea, specifically if you've dealt with this type of thing before. |

As a side note, you are almost definitely not covered under the national health insurance if your employer is not contributing to your pension.
Contact the health office and the pension office for those two issues.
Dial 1355 and 7 for english service with pension and 02-390-2000 for english service with health. You'll have to deal with each office individually to resolve each issue.

As these arent likely going to be your only problems, the number for the labor board is 1350. |

Say 20 people on Dave's complain about not getting pension and say 5% of the 23,000 E2 visa holders post on this site. That is 20/1150=1.7%. I am not saying there are more or less, but when you break it up it really isn't so many (if my made up numbers are correct). |

I have a friend who is going through this exact same thing...Only her employer admitted they were going against the law, and told her not to worry about it.They also decided to hold her airfare reimbursement money till she left. What her employer told her is that 60% of all hagwans do this; so that somehow makes it okay to break the law...whether or not that statistic is true, I don't know... |

Did you notice a previous poll where 37% had claimed not getting pension at all, plus more had claimed only getting pension from some of their places of work.
I am not saying there are more or less, but when you break it up it is really many (if my numbers are somewhat realistic). |

Let's also say Dave's is more or less representative of the general ESL population and let's use your numbers So 1.7% of 23000 would be=391 which is quite a few people.
However Dave's is NOT representative of the general ESL population. Said population seems to be made up of mostly newbies. Whereas on Dave's there are many old-timers who (presumably) have managed to sift though the chaff and get good solid jobs. So if anything it's likely higher in the general population. Many may not even be aware of their rights or that they are being shafted as well.
Yes 1.7% or even double at 3.4% (which is nearly 800) doesn't seem that much but when you break that down by people that's quite a sizable number. And if you are actually in that number of people, then knowing that it may be a small number is no consolation at all.
That said I would be very surprised if it were only 1.7% or 3.4% of people who were getting shafted in some way. Yes I have no real stats (apart from the poll, shaky though it is, the mass of anecdotal "evidence" I've heard over my 10 years here and the hundreds of contracts I've reviewed) but apparently that's acceptable for the opposing side so why not me? |

As of the time of me writing this, 20 people (the same amount I used in my example) have claimed not getting pension at some point (this is coming from the poll you mentioned). So my numbers have been proven! Asah!!!!!!!
I wonder if some of the people who answered in the poll answered because they couldn't get their pension due to their nationality and not because of the school not paying or was paying into a private pension.
Yes Urban, I agree that nobody should be cheated and it really must suck to get done in. Hopefully things will change and employees will fight for their rights. |

But, according to the poll, only 18 have claimed to getting pension at some point.
Let's see, that is 18/1150 = about 1.5%!

Its 18 members who have ANSWERED the poll. It's ridiculous to think that all dave's members (even a majority) even opened it.. how daves members may or may not represent the total population of teachers as a whole also cant be applied because there is no way to reliably extrapolate that, this is an anonymous forum. You cannot quantify using this kind of data. It's imperfect and the more you play with these 'numbers', the more ridiculous it gets. All these calculations are totally pointless.
Can everyone agree that there are too many employers cheating their employees? I hope so.

Of course it's ridiculous. I've been in Korea a long time. Of the 30 or so foreigners that I now know, there are 4 that are definitely not getting pension, probably more. |
