So I hear everyone say we need a clear CBC in order to be approved with a visa. Previous I was able to get around it with another state I lived in. But now with the national cbc requirement, I might be screwed. I planned on staying SK for 3 yrs...but now might be on my way out. Pretty upset about it....
I have something on there that was dismissed. However because the judge was running for office and wanted to slogan himself as " hard on crime" he wouldn't proclaim my innocence and of course gave me probation, and I was clear. Of course....
Anyway will Immigration give visa approval with a dismissed charge on it?
I've heard of this happening with MIP's or DUI's....
Any experience?? Advice? |

Typically they will deny ANY and EVERY application that does NOT have a clear
CBC. They are also facing a "get tough on criminals" situation.
China, Japan, Taiwan and you can still get away with a state check rather than a national one.
In many cases they are not required for Japan or China (depends on the province/region).

Have you ordered a FBI fingerprint check before to see if your record shows up? Typically, only serious arrests/charges are forwarded to the FBI's database, but it varies by state. So I suggest ordering the FBI check ASAP. |

Is FBI different than a national check? I remember getting a state and a national and it was on there... |

Yes, clearly it is a judge and not your actions to earn a criminal record that is to blame for your problem. |

talk to a lawyer, if it was a while ago and some stupid mistake if you explain you situation you may be able to get it expunged and get a clean record. All this will take a good amount of time though. |

First see if anything even shows up. The National check may actually show less than some state checks! Second, you can go for one without needing a national check as long as you do it soon. I don't think you need to plan 3 years in advance. Just take a one year contract for right now. |
