|
|
Would like to know if I get a letter of release from my current employer (completed the contract with them) what paperwork is needed for immigration to transfer over my visa to a new employer. That is, not leaving the country to apply for a new visa.
Do I just take the letter of release, passport, photos and new contract to the local immigration office? Is that all I need?
I have heard that new regulations are coming into place so would like to know what the current regulations are as of this day. |

Unless you can accomplish your transfer within the next 10 days I am no longer sure exactly they will require from you to complete a visa transfer.
Historically it was:
LOR
ARC
passport
new contract,
new employer's business registration
new employer's letter of guarantee (sponsorship)
application
60k won fee for the transfer
50k won fee to add a multi-entry permit (any previous re-entry privilege would be canceled with the transfer.
After Sept 1 you MAY (if I read the immigration specifics correctly) a Korean consulate verified copy of your degree (or one verified by the KCUE.) Their English website is here:
http://english.kcue.or.kr/sub_new_03_1.html.

thanks top cat you are 100% correct. have processed my visa (e2) with letter of release with the documents and cost that you stated.
And, the girl at immigration says that there are changes even if you do get a LOR after sept 1st. So am lucky as i didnt have further documents ready at hand.
Boy, its getting more and more exhaustive to stay in this country |

Does someone know what the procedure will be if we want to re-sign a contract with the same school? Will we need to get some new documents? |

Again, historically the same as above with the exception of the LOR.
There are new documents required after Sept 1 and Jan 1 (if you haven't submitted them already).

What new documents? I heard that you need a notorized version of your degree, which I have. What else do I need to transfer my visa with a letter of release? BTW I am Canadian. |

Most don't have the K-consulate certified (not notarized) degree copy (Canuks are lucky this time in that many have used k-consulate certified copies instead of the originals).
If you were one of those who used an original (instead of a certified copy) you need to get a copy certified by the k-consulate at home or by the KCUE here in Korea.
After the end of the year you also need to have or have already submitted a NATIONAL police check (again not an issue for (most) Canuks since all CBCs (should have) come from the CPIC database.

Argh, reading this post is depressing!
I am in a similar position, I have just received a letter of release from my company who are closing down my school.
I thought everything would be fine, but after my new employer spoke to immigration, apparently the LOR is useless if you have worked in your company for less than 6 months! This is absolute crap! So anyone who gets screwed by a school within 6 months just has to lump it and go home? Bull!
Not only that, but now I need to get my degree certified? Whats the point? Is my original with sealed transcripts not good enough? What on earth is up with these ridiculous procedures!
Does anyone know anything about this or have any advice as to what I could do? Is a letter of release timed? I.e, do I have a time limit in which to find a job. Not that this would matter with the 6 month rule off.
Any advice or help would be appreciated. |

You are correct. It won't matter as you must have worked 6 months to qualify for a LoR xfer. You must do a visa run with a new set of documents (including an apostilled diploma if you will make the run after sept 1). Many, many threads you can look up for detailed info on the process. |

What a total bunch of BS!
So due to my company going bust, which is nothing on my part, I am supposed to just drop my life and ship out? Nice work ROK!
As for the verified degree, are people sure this takes 4 weeks? Would one need this when applying for the E2 transfer, or could this be done at a later time?
Thanks |

Not sure where you are from so this is a little ambiguous.
IF you are from Canada you need a CBC (k-consulate verified or Canadian embassy verified) and have your degree verified by either the K-consulate in Canada or the KCUE in Korea.
If you are NOT from Canada you will need either:
1)
a) degree copy with apostille
b) degree copy with K-consulate certification
c) have your degree verified by the KCUE.
2) CBC
a) with apostille
b) certified by YOUR embassy in Korea (affidavit of authenticity). |

ttom thanks for the information.
I am from England, so I can have my Diploma verified here in Korea? (I have my official degree here now) How long does this process take? Say it takes 4 weeks, and the job I am transferring to starts before that, will I be screwed if the document is not ready?
Will I also need a CBC? I already had a CBC with an apostle when I entered the country 5 months ago so surely I don't need this again? |

for a transfer you will not need the cbc or verified degree (assuming the one you used originally had the apostille.
If you are getting a new visa then you need a complete set of new documents.
KCUE takes up to 4 weeks but you should have 30 days AFTER your last day of work before you have to leave Korea for your visa run.
IF your employer actually did go bust then you can USUALLY transfer to a new employer (assuming the old employer goes with you to immigration and you have a new contract).
You will need:
old employer (in person) to explain about going bust to immigration and transfer your sponsorship,
ARC
passport
new contract
new employer registration
new employer guarantor form
application to change employers
60k won fee .
Don't forget to apply for your re-entry permit at the same time (any old re-entry privileges won't carry over into the new period).

That is good news indeed, however I am sure I have seen another post that specified that even people simply transferring their E2 visa, had to acquire this new verified degree.
When I originally acquired my E2 in March, I had my CRC with an apostle, but not the degree. I simply had the official degree and sealed transcripts.
Do you mind if I ask where you get your source of information ttompatz?
I hope to god your information is true, but am sure I have read from someone who called immigration that everyone from Sept 1st, has to run through this verified degree crap.
I also need the original employer? Would it work with the new employer instead with a letter or such from the old employer?
Really appreciate the help.
Thanks again |

Information comes from immigration.
After Sept 1 you do indeed need a K-consulate verified, apostilled or KCUE checked degree. (pick one).
In the case of the school going bust the original sponsor (your employer) by your side will go a long way to smoothing the process to transfer to a new employer (especially if you are less than 6 months into your visa).
Immigration is not your enemy AND immigration will adjudicate each case on its own merits and CAN allow a transfer at less than 6 months if there are extenuating circumstances (like a business failure). They typically won't allow a transfer if it is just a matter of a disgruntled employee changing jobs after a few months.
