Has anyone heard of or know of anyone with an arrest on their record ( and no conviction ) and still finding a position? This is basically my situation. The CBC at the moment only shows convictions but come Jan. 1st with the FBI check any arrest will show up from what I understand. Thanks in advance.

I'd like to add I'm not a creeper and the arrest was for a very bogus d.u.i. (you can legally be arrested for simply being near your car while intoxicated) and the whole thing was dismissed but an arrest still shows up none the less.

DUI is not considered illegal in Korea....as long as you're drinking soju and not imported booze.

A name based cbc even in the state of arrest will not show said arrest. A federal cbc requires fingerprints and everything (a rap sheet) will show up from any state. It's on the federal cbc website.

i was arrested before, and nothing came up on my FBI check because i wasnt convicted--like you..

lol, no it happened 6-7 months before i got the FBI check. Im a teacher in the States, and when i was getting my documents ready to come here i went to get fingerprinted---i got the fingerprints done at my college and both the state level and FBI level are done at the same time. BOTH said NO CONVICTIONS or ARRESTS. believe i was sweating bullets before the results arrived.
the good thing for me and you is that ONLY SERIOUS arrests are forwarded to the FBI. Yours is NOT considered SERIOUS. Mine wasnt either, thank God. But this varies from state to state on what they forward to teh FBI. I lived in Ohio.

Thank you so much. I've scoured Dave's trying to get a good grasp on this. Hopefully i'll be in the clear as far as the fbi is concerned. Two things I've learned in life...don't drink and be anywhere near your car and don't. go. fishing. in. north. korea.

wait a minute, i just remembered....were you by any chance fingerprinted at the police station when you were arrested? They did not fingerprint me when i was booked, and i was released from jail the next morning on dropped charges. they took my mug shot but did not fingerprint me. I believe if YOU WERE FINGERPRINTED at the time you were arrested there is a good chance it will show in the FBI database. please tell me you werent fingerprinted

I in fact was fingerprinted so I may be screwed come next year and have to go back to the states. I may be screwed this year actually. I have secured a position and have to meet with the consulate rather soon for the E-2. Everything has been about convictions up until this point and on the E-2 app. it asks "arrested or convicted." I'm rather conflicted.

The only way you can find out what's on your CRC is to get a copy and read it.
