Search function is busted up, so here I go:

First time attempting to work in S. Korea as a teacher.

I accepted a contract from Kid's College in Gimpo City, subsequently my contact delivered the documents to Immigration.

First try they rejected my visa request based on my CBC having a dismissed class B misdemeanor possession charge back in 1997. Second try they still rejected based on my written explanation of the arrest and dismissal. I'm now on my third try, per the suggestion of my school sponsor, I've sent the actual court dismissal document and I'm awaiting their decision.

I expect them to reject it again.

My question is if I take the time to expunge the charge from my background (I had no idea immigration is this strict and in retrospect should have done this from the get go) thus having a clean background, will I be able to reapply for a visa? Is there a time limit to wait to reapply or does Immigration keep a blacklist record in their database?

I could even go so far as to knock out the FBI background, however what would be the point if I'm now blacklisted from working as an English teacher in S. Korea.

Would talking to the local Korean Consulate help my situation if I explain I submitted my paperwork without taking all the necessary steps?

Thank you for any help in advance.

- Johnny

It was a possession charge.

The only hope is to have it expunged and it must also be removed from your FBI check (the only one they will accept after Jan.1.).

If you can clear your federal check they will allow a visa.

If you cannot, you will NEVER get a work visa for Korea (because it was a drug related charge).

Your only other choice would be to get it expunged and try another country.
(clean CRCs are becoming a requirement for teaching visas in many countries now.)

I have no doubt I can get the charge removed, then a clear FBI background check, my hope is that I can reapply to S. Korea.

They rejected you once and they have that in their record. I doubt you'll be able to reapply. Razz

Records-keeping is sub par. It's always worth a try. How many times have we been asked to submit the same information to the education ministry? How many times have we had to submit the same documents to immigration?

Try, but have a back-up plan.

What are the guidelines for immigration anyway? If you have a DUI from over ten years ago, will you be rejected? What are they looking for? Drug charges? Violence-related charges?

I thought the CBC was for E-2, but not necessarily other work visas. Am I wrong? Do f visa holders need to submit these documents as well?
