Does anyone know if there is a deadline to HAVE the apostiled FBI CBC in hand to give to immigration for the March 1st resigning after January 1st? Is it necessary to have this document on January 1st, or can it come later? My Office of Education seems to have no idea of what is going on - will be sending off my CBC app today though it's looking a little grim as to whether it'll be done and back in time.

I called immigration on this myself.
You do not have to have the CRC etc.. completed on January 1st. Getting the stuff in the mail and processed, and back in your hands is the 1st step and you'll want to have that to finalize any contract offer before your 3/1 date.

I have the same concern as you about the timing though I think all we can do is get it processed as quickly as possible - then look to get that contract for the next round.

To be honest, I had this a bit backwards in my head. I was mentioning to my current school how I really needed to know if they were going to sign me again so I could complete the process. The truth is though, you need the paperwork done to then seal any contract (more or less). Having all the completed paperwork in hand may make this a slam dunk for some.....just a guess but I think a of people won't make it through the pipeline on this.

Is there an FBI office in Seoul that I can go to? How can I submit finger prints and all that while living in South Korea?

I posted a separate topic on this, but I've been informed by the coordinator at my Office of Education that they're going to scrap the changes to the E-2 Visa requirements this year and instead implement them in 2012.

I'm not sure if this is true or not, but would be good to find out for sure.

Yeah, before we spend extra money rushing to get the Fed version. Keep us posted.

That's the problem. There are so many conflicting stories. One would think that those who are staying with their same school would have some type of exemption.

OK---for those in Korea needing an FBI check, here's the deal:

You have to get your fingerprints taken here. No big deal, really. Then follow the process laid out on so many of these threads. Look around www.fbi.gov to find what you need.

It's a good idea to get it authenticated by the FBI when they do it.

BUT

If you've already sent away and forgotten authentication, I don't think you need to worry.

Either way, if you're in Korea, you DO NOT NEED AN APOSTILLE.

(to find this info, scroll over "Information" then choose "Immigration Guide" then "View" under Work/For More than 91 days" then view the requirements for the E2).

This means a sworn affidavit on your CBC from the US Embassy is enough to meet their requirements. This costs $50, and you should book an appointment ahead of time. Other than the cost and travel, it's a painless process.

There's also an interesting tidbit here:

Certification of criminal records is exempted for foreign instructors that are extending their stay for the first time, if they have entered or registered as foreigner before the revision of the law made it a requirement. Also, instead of submitting their health examination records, they must submit HIV test results and drug usage test (TBPE test) results.



My last point is that my girlfriend and I have had success calling our Congresspeople and asking them to expedite our request. We've both heard in the last 24 hours that ours are nearly finished, and had conversations to verify our address here in Korea. That may just be effective people in our Congresspeople's offices, or the fact we're in rural districts that have the time to help, but regardless, it worked.

According to the Seoul Metropolitan Office of Education, Korean immigration will accept state background checks until Dec 31 2010

But to clarify that - if you're getting your information for a contract after 1/1/11 you'll need the fed level background check.

Seems that I'm getting mixed information from this board and a recruiter:

Board - You only need to get the FBI check if you're coming in after January 1st

Recruiter - You need your FBI check to get your ARC in Korea, but can get in the country with a state CRC

I sent for the federal one a month ago, but haven't received it. I got some tracking number from the place I went to for the fingerprinting, but lost it. I also had an unofficial copy mailed to me.

I think that's for contracts beginning before Jan. 1. Even my local immigration office is requesting all of its current teachers to get an FBI check, even though we're already on contract.

Sorry for two in a row---would've addressed this the first time.

Board and recruiter are right, based on my research. With a contract after 1/1/11 you will need an FBI CBC eventually.

Yeah, but that would only be for contracts that are signed on or after 1/11/11, right?

If I signed a contract earlier than that (which I think I will), then I wouldn't have to get an FBI one unless I wanted to renew.

Seems like a huge pain in the ass. All I have is the state. Still got at least a few more weeks for the federal CRC.

Called the Attach� office in Seoul, she was completely unprofessional. Rude, refused to give me her name, couldn't even tell what was on the website.

What the hell do they do there anyway?

That is how it seems, yes. Keep in mind, though, as I posted earlier we were asked by our POE (maybe you're doing a hagwon, so it doesn't apply?) to get an FBI CBC, and our contracts are done in March.

I think you mistyped, but to avoid confusion, the date is Jan. 1 2011.
