So i signed on for a year originally, and I am at a supppper small hagwon
We have less than 20 children.
So 3 months ago after all my adult(college) students went to Canada, America, and College.
That ended the summer rush for me, and my boss told me then that if we dont get several students then we will probably have to close the school. Since we ran in the red, 2,000,000 a month, and i was taking all the money essentially
Which we have maintained the amount of students, so that means i am getting the ax.
So I am going home, but I guess my question is what am I eligible for?
I believe I saw a post with a similar situation, a long time ago. But cann't find it.
Is it legally, because my boss is breaking the contract, I am entitled to my bonus still and my plane ticket?
I do want the bonus money(of course), but only really care about the plane ticket.

as long as he gives you the required notice (1 month unless more is specified in the contract) he doesn't have to give you anything. Sucks i know but not much you can do. Your best bet would be to try to find a new job while in country if that's what you want. |

I second that. If you want to stay, your best bet is to find a new job, which should be easier since you're already in the country. |

Just a suggestion!
I would consider moving to another job here. You could ask your hagwon for a visa transfer which they surely would supply..
It would be easy to switch over then. Many people including this poster have not had a terrible start to their teaching life here turn them off Korea. If you switched jobs and started afresh it could all be very different..
Now, of course this is just a suggestion..
If life in Korea just isn't working out for you in any way outside of the hagwon and you are keen to get back home then that's fine too..
Just keep in mind making a switch would make things very different here. |

First
I was not given a months notice, I found out on Wednesday which was the 13th, and I was told I am to be done at the end of the month.
Second,
I do want to kinda stay here, but it is very close to holiday season in the States, and would really like to spend that time with my family.
Since I have this opportunity, and both my living grandparents are in their upper 80s. Because after this year, I dont know when i will be back for the holidays again. Since I plan to return, in January or February

Use this to negotiate a release letter. You can legally try to fight for the final month, but considering the situation they don't have the money to give you and it would just add stress.
Main thing here is to stay in the country if you want to continue working.

Make a decision. If you go home, you will need to get all the documents and it will be harder to find a school. |

I hate to be harsh but you will probably get nothing..
You MIGHT get some money for a plane fare but you can't get money from nothing. If the business is broke it will be tough...labour board won't be able to help you at all.
You ARE NOT ENTITLED to any bonus. This you can only get after a full year of work. You might be able to get a cheeky few months but the owner doesn't have to pay you anything.
Sorry to be the bearer of bad news. I know you weren't given a month but if there is no business you can't do much about it. Live and learn. |

So now my boss is telling me she is keeping half of my last pay check
to pay for my original flight into the country.
And to help cut her losses on me
I told that is illegal and she cann't do that.
:She said that is her offer and opinion. Which is why it is fair" |

Woah! Well, what did your original contract look like?
I wish I could offer constructive advice. Google "EFL Law Korea" and start looking around...
Get what you can get!
Personally, though, it's probably best for you to go back home, spend the holidays with your family, and negotiate another job from there. Take a rest  |

Check your contract. It may say something like the airfare to Korea is considered a loan and if you stop working before 6 months (for any reason) you have to repay the flight (loan) back to the employer.
Good luck.
PS: Forget the labor board. If you haven't worked 6 months - you're not covered - and in your situation (business broke) - you're not going to get anything from your employer.
I'd ask to be paid weekly (until the business closes). If you wait for any money until the last day - you will most likely not be paid anything ("Sorry, things changeee, no money, goodbye."). |
