Here's my story: (point me to the appropriate thread if this has been covered)
-Got a DUI seven years ago.
-Got a diversion. Said DUI is off my record.
-State background check is clean. (This is from the state where I was arrested. My state will give them to you online. How handy.)
However, I have heard conflicting reports that the ARREST will still show up on an FBI CBC. If it does, will Korean immigration even care? Thanks. |

i know misdemeanors drop off your record every 7 years. You may still have an arrest record though. The BIGGEST questions are: Were you fingerprinted? Did the Clerk of Courts process your papers? Were you booked? If the answer is yes to any of those questions, then yes, you are in the database, and your name will pop up on the search (the fingerprints will match.) If you were not fingerprinted, you don't have much of anything to worry about because you weren't booked and your fingerprints were not submitted to either the State nor Federal level.
Go to the city's court website were you went to court and check the "court dockets" with your name. It should give you the disposition and what is on your public record.
The funny thing is that a lot of the times, small crimes don't go past the Municipal level (your city) and stays ONLY at that courthouse in THEIR record files only. More serious offenses ARE forwarded to the State and Federal database via the National Crime Information Center (NCIC), again, this is what the Clerk of Courts personnel does after you've gotten booked, fingerprinted and all that good stuff.
Good luck, but the only way you can be sure is to get the CBC and find out yourself. Ive done extensive research on this subject, and by my estimation, you may be in the clear IF you weren't fingerprinted. |

also, you may want to make an account and ask your question at this site below. I used it when i was thinking about going into the Military where i would have needed a security clearance. These are smart guys, and know what pops up on background investigations and CBC's

Thanks for the input guys.
I'm in China right now and I'm trying to see if it's worth the hassle to get one. Chinese cops are less than helpful when it comes to helping foreigners get things done other than the normal "blue sheet." I could dangle a carton of cigarettes and see what happens.  |
