late 2010 vs early 2011 visa question (American)

If I get a job in December, I can get away with just the state check/apostille, right?

But as of Jan 1st, it MUST be a Fed check/apostille, right?

Anyway...I've heard I can show up early in 2011 with just a state check/apostille, but sign an agreement explaining that I'll promise to get a Fed check/apostille ASAP. I've also heard I have until 2012 to do this, or does this just apply to people already in the country?

Anyway, I don't expect a tremendous amount of jobs to be available in December as the semester ends, so at this point, if something did go wrong with my Fed Check Apostille process...perhaps I should consider China based on current market conditions and all this hassle?

I don't think you can do this "ASAP". It takes a while. If you applied now, it will be 2011 before you get it. These I think are good for 6 months. So, you will have plenty of time to find a job, especially for the new school year in March.

I wouldn't worry about China unless you really want that. Try Korea instead with a "Fed check". Why do it twice (and from Korea)? Confused

I'm in the same boat - looking to start working right after New Years, which means I'd be getting my visa BEFORE 2011. My *understanding* (the caveat being I'm not sure how accurate this is, I figure I'll find out once I sign a contract and get the visa number) is that yes, if you are getting the visa before the New Year, you can use the state-level CBC and then send over the FBI one after you're there. But I'd still put in for yours ASAP..I've got my apostilled state CBC ready to go, and put in for the FBI one last month. Hoping to get it back in a couple of weeks.
