Posted: Mon Nov 22, 2010 3:44 am Post subject: I quit my job, but my boss won't give me a leaving date. |

I submitted my notice to quit because of family reasons and my boss is hemming and hawing about giving me a date to leave. My contract says I need to give six weeks notice, but I am hoping to leave sooner and I have told him as much. Does anyone have any advice on how to move this along faster? He does this every time I ask for something. It makes me so mad that he would do this with an emergency. I feel like cattle more than ever. |

You've submitted six weeks' notice? Leave that date. Better yet, leave that date after you get paid. |

He is looking out for number one, and so should you. If you have to go, go. Family is more important than any job, and if worse comes to worst he can find somebody to replace you temporarily til they find a new person. Don't let him tell you that he can't. |

If it's a true family emergency, then just go when you need to go-few would fault you for that.
But if you have the luxury of a little time, and you want to do it by the book, just give the notice that the contract calls for. Can't really be faulted for that either. |

You can leave whenever you want. Immigration won't stop you.
You need to weigh how important your family emergency is against how much money you stand to loose. Often, many teachers wait till pay day and just do a midnight run.
If you wish to return to Korea it may pay to inform immigration at the airport that you wish to cancel your E2 and then hand them your ID card. Then start from scratch once you have your affairs in order. |

Can I cancel the visa by myself? I thought the employer had to be present. When everything is sorted out, I want to return to Korea so I would rather not run.
My current visa expires in May, is this possible:
-cancel the visa myself
-leave Korea, sort things out at home
-return to Korea prior to the May expiration date at a different school |

It would only be a run, or more accurately, "breaking the contract", if you left without giving proper notice per the contract. But as I said before, if it truly is an emergency, few could fault you for doing that. You have not given many details, so it is hard to say. That's for you to determine.
To answer your question, yes, you can cancel your visa by yourself by handing in your arc card on the way out of the country and telling immi to do just that. The only time you would need your employer with you at immi is if he had agreed to give you a Letter of Release.

Yes, this is very possible - I think many have done this before you. As long as immi does their job and cancels it promptly, you should not have a problem. If it does come up with a prospective new employer you should be able to cite "extenuating circumstances". |

Yes, but you have to make arrangements with the pension office. Normally this is done before you leave and in person, because you have to show them your outgoing ticket and tell them where to transfer the money. But I am pretty sure you can do it after you leave, though it may be more difficult due to the language barrier. |
