"obvious?" It was an allegation. Not that I think Mr. Hussain was making it up or that the cops didn't do a pretty poor job of the investigation. But unless the cops themselves witnessed it...nothing was obvious.
And no they didn't take the case to the HRC...they filed the charges pertaining to the case with the police and then complained about the police officers' conduct to the HRC.
As for foreigners getting into "legal situations" with a Korean? There've been quite a few situations of foreigners winning their cases at the Labor board/courts posted on here...it's not always so one-sided.
And we only usually get one side of the story as in those other cases.
If someone goes "A Korean man beat me up"...most posters will likely be sympathetic. But if he then reveals he provoked the incident...probably not. |

I think the moral of the story is that it's probably best to avoid conflicts whenever possible and not call attention to problems thast don't directly involve you.
I can understand the outrage but I can't see it resulting in any dramatic social changes in Korea any time soon. |

But I also know that police in almost every country tend to protect their own citizens more than others, so I am not sure its a Korean thing or not.
But people should always keep in mind to stay humble in front of a policeman and not to make them feel their authority being challenged. |
1. Yeah, I think Bonojit Hussain's was one of the biggest groundbreaking complaints of this magnitude so far.
2. I don't think that is completely accurate. There is not the same level of denial and outright avoidance of rule of law when it comes to non-citizens.
3. Couldn't agree more. |

Excuse me, but in all of the incidents I listed, it certainly WAS NOT obvious that the foreigner was at fault, although that was the reflexive stance of police EVERY time, even in the midst of a volatile and inebriated Korean subject (*And in the case of assault and rape, the rape victim was accused, even with a cerebral hemorrhage and huge bruise on her face, in a hospital emergency room, until a Korean showed up on her behalf of course). This is no doubt a serious problem in the Country that needs to be addressed, and there is no denying it.
Anyway, the Korean harasser of Bonojit Hussain was convicted and fined, and the police officers reprimanded for their poor behavior in handling this case. A precedent? One can only hope so.

A non-point. Of course they filed charges with police first. That didn't work before getting others involved. Anyway, you say tomatoe, I say tomato - who cares? The point is they handled it well and garnered enough attention from NGOs and the media to get the HRC involved. The bottom line is that they set an important precedent.

[color=blue]Yes, I have heard of foreigners winning labor disputes, but that is usually handled by the Labor Board, and not the police department, which is the topic here.
And yes, of course, we are talking about incidents like the few I outlined previously, where the foreigner did nothing and was in fact the victim, but instantly became the accused.[/color]
