Contract Ends March 8th 2011 At Public Shool? Leave When?

I am at a public school, and my contract finishes March 8th, 2011. I will be leaving this school.

Since school starts March 1st, will I be asked leave early so that a new replacement can start at the very beginning of the school year?

If I'm not asked to leave early, then will I be required to work March 7th and 8th, then quickly leave Korea on March 8th (since my contract/visa expires March 8th)?

You will be required to work until the day your contract is over.

DO NOT WORK LESS, even if they ask you. Because by terminating your contract even ONE DAY early, you will be forfeiting your severance, return airfare AND pension.

You will work March 7th and 8th. You will then have 10 days to leave the country legally.

During this 10 days time the school is not required to pay for your apartment. In fact, the new teacher will probably be moving into it.

One more thing to consider. Make sure you E2 is good until the last day of your contract. If you arrived a few days early you will need to renew your E2 to make sure you are covered through your whole contract.

No no no. OP, look at your ARC. When does it expire? You have to leave the country on the date that is written on the ARC unless you get an extension. Your contract ends on Mar 8th but your ARC might be another date. Some schools are nicer than others, your school might let you leave a few days early. But make sure you get all your money before agreeing. BTW you can extend up to 30 days for free after your contract finishes.

No you do not forfeit your pension and most likely not your airfare but your severanceis another matter. That you could possibly lose but it all depends on your school and how you treated them.

But if they want you to leave early then make sure they pay you your severance and airfare before agreeing to do so.

I've never heard this. When I finished my contract back in March this year, I was foolish and left the day after my ARC expired and got held up at airport immigration for a few minutes but I didn't have to pay a fine.

If you wish to look for another job, study, or even explore around Asia after your term expires, then you can go to immigration and extend your date of sojourn by up to 3 months I believe. It'll cost about 60,000 won.

If you leave too late, you probably would need to pay anywhere from 100,000-1,000,000 won depending on the case.

I think the 10 days might be old information that I found on a couple of other sites.

If you do not finish a full year, the school will not be obligated to pay your severance or airfare. If you quit early, get it in writing that you will get these two things paid out in full.

To collect pension, you must work a full year. If you quit/get fired in the 11th month, you don't get your money.

Run the risk of giving up your legal and contractual rights by leaving 2 days early? Not a good idea. Finish the contract.

That is simply not true. Pension is a government program not regulated by your contract. You have to pay into according to LAW not contract clauses.

You have to work a full year to get your severance but pension laws are different.

The requirement to get your pension is to be from one of the countries who get a full refund, fill out a form and show a plane ticket to another country.

You are required to complete your contract. (so you will be expected to work until the 8th).

You are required to leave Korea by midnight on the expiry of your ARC (your contract doesn't matter to immigration).

If your ARC expires BEFORE your contract then you MUST get an ARC extension within the last 60 days of your ARC.

IF you stay beyond the expiry of your ARC without an extension you will be in violation of immigration law and WILL be subject to delays, fines and possible detention if you are caught or when you do try to leave.

What Mr. ttompatz said. To anyone else who is confused these are the rules regarding pension, severance, airfare and the 10 days thing:

Pension: If you are from one of the countries that get a lump sum refund you are entitled to claim it NO MATTER WHEN YOU QUIT. This has nothing to do with finishing the contract. You get what you paid in (as long as you do the required paperwork.) Period.

Severance: If you work even one day LESS then required by contract then you MAY not get it. It depends if your school is a stickler for the rules or not. Legally you are not entitled to it though.


Airfare. This is a contractual issue. If the contract states that you must complete the contract before getting airfare back then that is that.


The ten days thing is old information...it has not been true for years. Mr. ttompatz has it right above.

Have you asked your school any of these questions? Certainly the advice you've got on this thread about pension and severance will
