Well the FBI check for Americans kicked in. And, of course I waited until the last minute. Just called and they told me it would take 12 weeks.
I'm actually on a D-2 visa at the moment. So, I will be in the country regardless. But, I was wondering if there any loopholes that anyone is aware of?
Possibility of immigration still taking the state check? (Out if ignorance or apathy) |

I think your local "bi"office can do it..only takes 10-14 days from what I read on the website.
Check with your state as all of them have one. For example,I live in in GA, so ours' would be the GBI.
Actually, it was a recruiter that made this suggestion. I would have never even though of this. |

Yeah I'm pretty sure this is not going to work. Your state's "BI" is only going to run the check on that state. This was the thing Korean Immi has been trying to undo for the last 6 months. Do you really want to take the chance of just getting a statewide check and hope it works? Hardly.
Bite the bullet and get the FBI check done. I've seen a lot of job posts that state as long as you've sent the check off and it's getting done they will proceed as normal. |

Maybe my understanding is wrong but I thought the statewide was good in lieu of the FBI before Jan 1st and served as a way to secure your positon UNTIL the FBI came back after Jan. 1st. |

Fromthe FBI website:
"Identification Record may not reflect all instances in which you were arrested and fingerprinted. The FBI maintains criminal history records voluntarily submitted by local, state, federal, and certain international agencies. You may need to contact the arresting agency or the repository of the state in which the arrest(s) occurred for criminal history record information. A state repository is responsible for maintaining and updating state criminal history records"
State "bi" is the same thing. They just resubmit it over the FBI.
Local, town and county jursidiction is the one that is different ( with the expection of major felonies, your arrest usually won't show up EXCEPT on a town or county records' check). |

Not quite correct....all felonies are automatically recorded/reported with the Federal Bureau of Intimidation.....not only so called "major felony."
However, not all misdemeanors are reported....but a high percentage are.
I know of a gal who was arrested last March in San Fran.......the charge was....threatening to kill someone.....she shot off her mouth at some idiot who hit her car....tempers were flairing....cops called......the person who hit her car claimed..."she threatened to kill me." Cops arrested my friend.....misdemeanor charge....case never made it to court....parties settled out of court...she submits a new "criminal records check" for her korean job and the record shows the misdemeanor charge!
Shoplifting is a misdemeanor if it's under a certain amount of money...and has been reportd......has many folks have found out.
Big brother is keeping tabs on all folks and wants as much info as possible.... |
