The pirates have no respect for American might. How can they when a spineless, gutless president occupies the White House.
Piracy on the high seas is inexcusable. Obama will treat them with kid gloves, like some sort of lawyer who is terrified of being sued. He refuses or is afraid of projecting American might around the globe.
The pirates are nothing. Wait until Iran gets the bomb. |

Even if they are guilty, that doesn't necessarily mean their punishment should be summary execution. Our justice system isn't just about determining guilt, after all; proper sentencing is also a part of the process. One pirate was recently sentenced to 34 years in prison for example. You're essentially saying he should have just been shot in the head. That's a pretty stark change in policy. |
I've been inside U.S. prisons before (not as a resident), but haven't lived in Somalia... but I'm going to guess I'd rather be a prisoner in the former than a free man in the latter.
The United Nations Convention on the Law of the Sea states that the courts of the State which has seized a pirate ship may decide the penalties imposed. Amendment 5 of the U.S. Constitution states that "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia...". The fact that it says "person" rather than "citizen" means that a pirate (being a person) may be entitled to a Grand Jury trial.
I'd prefer summary executions in cases where no State has jurisdiction, but I'll defer to my country's supreme law on this one. |
