I went to the American Embassy and the Korean Immigration Office today. I will post what was told to my fiencee and then translated to me in Korean by her. She speaks great English, but I will not guarantee the validity of the statements 100%. I will however post exactly what was told to us by the Korean Immigration (in Korean) because they printed it out for me.
The letter from Korean Immigration stating what I need to bring for the F-2 says the following:
1. 여권, 반명함판칼라사진 1장, 신청서(별지34호 서식), 수수료
2. 배우자 혼인관계증명서 (혼인사실등재), 주민등록등본(신청일로부터 3개월 이내)
3. 자국정부 발행한 유효한 결혼증명서 원본
->영어,한자권 국가가 아닌경우 결혼증명서 번역,공증이 필요
*영미법계 국가(미국, 캐나다, 영국, 뉴질랜드, 호주 등) 국민으로 국내에서 혼인신고를 먼저하여 자국 결혼증명서 발급이 안되는 경우 혼인 당사자의 인적사항 및 혼인신고사항이 적시되어 있고, 주한 자국공관영사의 확인이 되어 있는 혼인성립서류 제출 시 유효한 것으로 인정 (2011.2.14/ 사회통합과-831)
4. 재정입증관련서류 (재직증명서 또는 전세계약서 또는 등기부등본 또는 은행잔고증명 등)
*주거의 안정을 입증하는 자료
5. 신원보증서 원본(신원보증인:배우자)

Now, this states the normal requirements: passport, application, financial guarantee, proof of employment, etc. However, what we are concerned with is #3. FROM WHAT I HAVE BEEN TOLD, this says that "if you get married in Korea and are unable to get a marriage certificate issued by your home country, then you need to take your KOREAN marriage certificate to the American Embassy (or other country's embassy) and have them stamp the KOREAN marriage certificate. Voila, requirement fulfilled!
Ok, why does the embassy just stamp it? and what do they stamp it with? I dunno, but....
We went to the American Embassy and asked them if we brought our KOREAN marriage certtificate in, would they stamp it. They said yes, they could do that. However, the person we talked to had not heard of this being done before. SUPRISE!!
With that said, the lady at Immigration did recommend for us to legalize the marriage in the US as it would save us a lot of headache. Why? I dunno. I didn't want to spend any more time in Immigration than I needed to. The wait was long enough. However, I think we are going to take her advice and just do the legal paperwork in Guam on our honeymoon.

This is what it says on the American Embassy site:
NOTE: The Embassy understands that the Republic of Korea no longer issues F-2 visas to the foreign spouses of Korean citizens married in Korea after January 1, 2011. American citizens have reported to the Embassy that the Korean Immigration Service does not accept the �Verification of Marriage� form issued by Korean ward offices as the sole proof of marriage in Korea. Americans, as is true for other foreign nationals, married in Korea after January 1, 2011, are therefore unable to change status to a Korean F-2 visa. American citizens who qualify for temporary stay status or valid visa categories remain eligible to remain in Korea per the specific terms of Korean immigration law.
Korean Immigration accepts valid marriage certificates from other countries. Americans who were married outside Korea have not had the same difficulties in changing their visa status as their marriage certificates were not issued by a Korean ward office. |

Yea, I started another thread about marriage in Guam. I want to know if we can go there for a short vacation and get a marriage certificate. |

Would this even be legal?

"Sorry honey, lost my job. I have to do a visa run to go back to being on a tourist visa, then do another when I actually get a job. And I'll have to find a job in three months or do a THIRD visa run."

This isn't the US govt. fault; it's the Korean govt. that's the problem. They expect foreign government's to work for them. Korea world-hub! |

This is not true. Other countries have worked out deals. Canada has a new affidavit that they provide which is sufficient to obtain an F-2.
Basically they want to see proof that the marriage is recognized in the foreign country as well, and the previous form was insufficient.
and no you can't get remarried in another place. Once you're married, that is it.
You'd need to see about somehow talking some government official back home into issuing you an american marriage license, but I don't think they'll do it.

Why did the embassy stop issuing the certificate?
In my experience, the embassy is staffed with people who are rude and just don't care about customer service. If they can't or won't help you, they don't even have the decency to be friendly about it or help you figure out who can. Of course, that's just my experience, and as a tax payer, I find it unacceptable. |

So what does this mean, if you get married to a Korean in Korea you can't get an F class visa? You're stuck with an E2? I'd shoot myself. |

Just do yourself a favor and don't get married. Period. |

They all did. It was because of a court ruling and those forms were now insufficient for what they required.

As I said before, I got my F-2 this year. So whatever problems the US embassy had have been worked out. Somebody needs to update their research. |

As I said before, I got my F-2 this year. So whatever problems the US embassy had have been worked out. Somebody needs to update their research. |
So are you saying that you were married at the US embassy after January 1st 2011 and that they issued you a marriage certificate? |
