school is asking me to work every other Saturday morning - its not teaching, its deskwarming.
I've said no, but they say I have to, and theyll offer overtime pay. Anyone who has seen the EPIK contract knows paid non-teaching overtime is W6000 an hour...
Anyway, am at loggerheads with principal over it, who insists I have to do it and if i dont want to theyll deduct the missed Saturdays from my holiday allowance...
The Dept of Education is now invovled so hopeuflly it'll right itself, but we're both citing different parts of the contract to justify ourselves..
I work 40 hrs, teach 22 - some of my after school classes get cancelled due to sutdents' other commitments, and on this basis the school also argue i should make up the time on Saturdays teaching "temporary english programs" (quoted from the contract as the only reason to work saturdays). The last teacher worked the sautrdays and said these temporary programs never materialised, but he had to be present in case kids showed up... Like the school will officially schedule it to make him come in, but not actually run the classes....
Am i right in thinking the 22 hours must fall within the 40 hour week? If i do 40 hours, but only teach 20 (do prep etc the other 20), is it still hitting my contracted hours?
As i say, DoE is invovled now, but any advice or similar experiences anyones ahd would be useful.,.. |

I'm in SMOE, which I think was taken over by/combined with EPIK. All I can say is, if my principal tried that on me, they would show up on Saturday morning to find the apartment empty. But then again, I think Mon-Fri is written in the SMOE contracts (I'm not sure, I keep it at home, not at school)? |

They basically pounded it into our heads in orientation that foreign EPIK teachers DO NOT work Saturdays. |

they know for fact that NETs don't work on saturdays. they are testing you to see if you'll bend(-over and take it).  |

Don't do it. I occasionally do an extra Saturday class for EPIK for the schools without NETs, but I get paid 90k for 3 hours. It's not mandatory, but they like us to do them, so most teacher in Incheon do 2 Saturdays per year. That is all. Again, it's not mandatory. |

I assume you have the standard EPIK contract.
Show him the clause in your contract that says you ONLY WORK M-F and do NOT work Saturdays, Sundays or holidays.

i have a copy on my email - ive copied the clause below and put in bold the areas we are fighitng over.
as you can see - it says no saturday work
it also says - the employer may require the employee to work some, and also "temporary english programs". that is how they are trying to make me work sats - for these temp classes or for W6000 non-instructional overtime.
also - is my employer the school, epik, or my agency?

⑤ If the Employee agrees to teach instructional hours that occur outside the Work Hours specified in Article 8, clause ① and that total more than 22 hours per week, the Employer shall pay according to Article 8, clause ③. If the Employee agrees to teach instructional hours that occur outside the Work Hours specified in Article 8, clause ① but that total less than 22 hours per week, the Employer shall have the authority to determine the appropriate supplementary overtime pay. |

Bolded clause says you "SHALL NOT WORK." Underlined clause says nothing about you "SHALL WORK" those temp programs. It just says temp programs will "OCCUR" or happen. So you can just let it happen and you shall not work on the weekend.

it also says "if you AGREE" so if you don't agree it's ok.  |

Totally your choice. Even if they schedule classes or your time, don't show up. There's absolutely nothing they can do (can't deduct holidays, pay, anything like that). |

well, had more to-ing and fro-ing... its really coming down to this now:

theyve said they are disappointed about my lack of concern over my duty to the kids, how i dont care about their education.... i said i care within the confines of my contract, no more no less... (i did say, if had known about the saturdays before i signed the contract, i would have taken another job instead (tefl and experience, wasnt short on offers), but thats different from me saying ill quit.
i was also told they are "disappointed if i dont want to wrk for them anymore" .. it doesnt make perfect sense but i think you get the jist... its them putting words in my mouth, or hinting theyll sack me if i dont do these saturdays...
thing is, i like the job, the apartment, i do not want to leave or change jobs, its by and large an excellent job with good ay and a good apartment, the coteachers are great and i have friends here. its simply this saturday deskwarming which is baffling and frustrating.

yeah - for 2 years!
he said he tried to fight it but they wouldnt budge, so he gave in and worked them. at first he watched dvds, played ping pong with the kids, etc. but tehn he started needing to do some lesson prep or report writing.. then he started doing arts and crafts with the kids, and so on.. by the end he said he actually enjoyed them and it was a useful way to get little errands done. |

Don't work the Saturday.
Funny thing, half the teachers in my office seem to think I do come in on Saturdays, although all of them that think so aren't English teachers. |
