Agree with the above poster.
Plus it is her that needs to handle HER BUSINESS. You made mistakes, she needs to remedy that and deal with the consequences of her bad business practices. You are not responsible ethically or financially for her business.
Do you not think in any business employee's have cost their business money? Do you think any business has the right to sue an employee for any financial loss? It sounds like you care too much and feel overly responsible for a business that is not your own. Really let those feelings go and take care of your own business, you. |

At one time WAY back when, I was in a similar situation. I gave proper notice to my employer and was very professional. They, or the supervisor and her supervisor to be more specific, went bonkers. Face, and loss of it.
First they told me I had to pay back this sum and that sum. Then they told me that they would let one of the return payments go as I had provided professional service over an extent of time. I didn't budge. Then they were going to sue me. I didn't budge. As one other poster suggested the OP do, I marched my ticked off butt down to the labour board and filed with them.
In the end, not only did I NOT have to pay back anything, the school ended up paying a fine and having to pay me my last month's wages.
If you know you are in the right, don't budge to any large degree. Sometimes you can work things out, sometimes you can't.
But to this day, I tell anyone who asks to LIE LIKE CRAZY if you have to or want to exit a contract here. Your dog got syphillis, your aunt needs your bone marrow, your dad went crazy and is planning on lighting the house on fire if you don't get home right away. ANYTHING. It is what Koreans do when they leave, and should not be interpreted in the same way as it would be 'back home'. It's all about face here, and no matter what you tell someone, it will be interpreted as you don't like them so you must suck.
Do what you will, but be warned. |

My MIl has been threatened to be sued several times. The most recent was some ignorant ajumma who asked her to perm her hair or some other hair treatment. MIL said 'your hair will likely fall out.' I guess she had some damage to her hair already. The lady said that is okay and she'd take the risk.
Come 2 weeks later, she comes back and wants some sort of repair treatment for free. MIL said no and she threatened to sue her. MIl said '하세요'.
Inform labor board and call their bluff. Best response.

Had a long talk with my boss today, so I have a question.
How much can I be sued for? She wants to sue me for "damage" done to her school because two students have left the school. I know that any financial losses are the sole responsibility of the employer, but what kind of damage can I be sued for? I can fight a lot of her claims in court surrounding the two kids leaving, but yes I've been late in the past many times to work. Can i be sued for being 10-15 mins to work multiple times? If I fight a lot of her claims it makes her argument seem chancy at best because her short temper to blame for the students leaving too.
Hmm lawyers cost thousands of dollars right? Hmm, I could represent myself maybe? |

| Also, we're negotiating outside of court for some amount that should come out of my paycheck that way we won't both have to go to court. Yeah, I stand a good chance of winning in court, but is it worth say 700k-1 million won of pay to get out of settling this at the labor board and court? Also, I don't trust her at all anymore, so could she potential screw me if I agree to give her some amount before she actually pays me? |

She can't sue you for it. She is blowing smoke up your AZZ.
Her ONLY remedy for a bad employee is to terminate the employment unless you WILLFULLY caused actual DAMAGE to PHYSICAL stuff or actually went out of your way to defame her business. (don't picket outside the door and say it is a bad school).
She CANNOT legally take ANY deductions other than provided for by law (tax, medical, pension) out of your pay.

Are you personally wealthy? I would fight tooth and nail for 70,000 won. For 700,000, I'd do a lot worse.

She's not gonna sue....nobody would sue an ex-employee for doing a crappy job. Can you sue a boss for being a bad manager?
C'mon, she's bluffing you. I can't believe your falling for this. Most hagwon bosses have better bluffs than this.
There aren't as many lawyers here and the few that are are quite expensive. Koreans rarely sue like the states...they tend to settle things outside the courtroom...sometimes with bags of money.
I brought a lawyer for a different type of case and the Korean guy practically pissed his pants and cried.
That's how uncommon bringing a lawyer out is.
90% chance her next bluff will be "I have a friend at immigration"...and the classic "you'll never work in this town again"(korean version!). |

Also remember that if she sues you (unlikely) and you win (very likely), the court will require her to pay all of your legal expenses. This includes transportation to and from the court, lost wages due to meetings with lawyers and being in court, and so on (so long as you keep receipts).
I know because I had to sue my landlord and all of this was explained by the lawyer when we were deciding if we would move forward with the lawsuit. I did sue and I won, and sure enough, the landlord not only had to pay the settlement, but he also had to pay all of my legal costs, which came out to about 15 million won.
So, you might need to lay down some cash (many lawyers will wait until the end of the trial to get paid) for the lawyer, but since you should win any lawsuit brought against you, you'll get all of your money back. |

| OP, where do you live? If you are near me, I am willing to put on a suit and go to your school and have a talk with your boss. I will claim to be from some agency that helps foreigners who are being victimized. |

THANK YOU SO MUCH!!!!! Reading this and the comments posted here makes me feel sooooo much better. I've been panning and thinking about all the possible outcomes from this, and I didn't even know that I can't be sued for something like this. Now I know anything she tells me is just a bluff to get me to surrender some of my money. All I need to do is file the complaint at the labor board, and they will take care of the rest? Sounds amazing. I can tell my boss is really bad at bluffing and negotiating (she gave me the usual treatment I've read up about), but damn her main bluff just went out the window. She tried to persuade me so much to settle today, so it all makes sense now.
I just have to be the first one to go the labor board to give my side of the story right? |
