I have been told that the old rule about being able to transfer your visa between hakwans was contingent on being at the hakwan for nine months was changed. My school is going under due to management conflict and they are telling me I can transfer my visa to a new school without problem even though I just got my ARC. I know before I could change to a public school but not to another hakwan in such a short time. School is absolutely co-opertative on giving me whatever I need. |

It has always been possible to transfer without restriction if the school was closing (out of business) or letting you go due to financial difficulties without regards to length of time completed on your contract.

ttompatz, do you know if I need any documents to do the transfer? A new school asked about me bringing my docs. in but admittedley the English teacher at the school has always had recruiters handle it and doesn't know. I will call about tomorrow but if I can get an answer here that would be helpful. |

1st transfer or change since the new rules came in then you need:
1) LOR
2) ARC
3) passport
4) new contract
5) new school's business registration (copy)
6) new school's letter of guarantee (sponsorship form)
7) application
fee.

New rule is one month I believe.
I've done it too....just have the LOR ready....if your transfer before the contract period is over significantly* they don't even need new docs like the FBI check. They just change your workplace...took 20 minutes.
I transferred after 2 months with no hiccups. School was not going down the tubes either.
*no point in transferring if the contract will be up in 1 months, then you might need new docs. |

So I have a month before I actually need to go to immi and do the transfre? I have my ARC now and a letter of release and start at my new PS on Friday. I thought I would have to go to imi and do the transfer immediately. So there is a bit of a window? My Koreaan co-teacher is new at all this so I need to verify for my own piece of mine. |

No.
There is a maximum of 30 days between contracts (if there is a delay between ending one and starting the other).
If you are doing a transfer it SHOULD be done before you begin work at the 2nd employer (to ensure that the transfer is allowed by Kimmi and that there are no complications).
Under the new "reporting" rules, the you can theoretically change locations of employment and start work up to 14 days before you do the paperwork but if there is any problem you are up the creek and have no time left to fix it.
Do it ASAP.

Do I need to have worked at my present employer at least 6 months before I can transfer? I think that is how it was in the past.
Don't I need to submit Federal background check if I want to do any thing at immi? I always used my state background check in the past? |
